Although the UAE has become an enforcement-friendly jurisdiction in recent years, enforcement remains substantively and strictly selective.\n  <\/p>\n<p>\n    There are numerous final decisions that the UAE courts will not enforce, or will enforce only in a significantly reduced form.\n  <\/p>\n<h2>What cannot be enforced in the UAE even if it is final and binding?<\/h2>\n<h3>1. Decisions contrary to public policy or morality<\/h3>\n<p>\n    Decisions that are contrary to UAE public policy or moral standards are not enforceable, in particular where they relate to:\n  <\/p>\n<ul>\n<li>gambling,<\/li>\n<li>pornography,<\/li>\n<li>extramarital cohabitation or sexual conduct,<\/li>\n<li>obligations that are openly contrary to the fundamental principles of Islam.<\/li>\n<\/ul>\n<p>\n    This constitutes an absolute bar to enforcement.\n  <\/p>\n<h3>2. Judgments containing interest (in whole or in part)<\/h3>\n<p>\n    The UAE does not automatically prohibit interest, but the following are not enforceable:\n  <\/p>\n<ul>\n<li>usurious,<\/li>\n<li>penal in nature,<\/li>\n<li>or Sharia-non-compliant interest calculations.<\/li>\n<\/ul>\n<p>\n    It is common for enforcement to be permitted only in respect of the principal claim, with the interest portion excluded.\n  <\/p>\n<h3>3. Punitive damages<\/h3>\n<p>\n    The concept of punitive damages is unknown in UAE law. Accordingly:\n  <\/p>\n<ul>\n<li>deterrent or exemplary amounts awarded in common law jurisdictions are not enforceable. Only proven, actual loss may be considered.<\/li>\n<\/ul>\n<h3>4. Certain elements of family law decisions<\/h3>\n<p>\n    The following are typically excluded:\n  <\/p>\n<ul>\n<li>recognition of same-sex marriages,<\/li>\n<li>child custody or religious upbringing provisions contrary to Islamic legal principles,<\/li>\n<li>foreign orders concerning personal status.<\/li>\n<\/ul>\n<p>\n    In such cases, the court applies its own independent assessment.\n  <\/p>\n<h3>5. Matters falling within the UAE\u2019s exclusive jurisdiction<\/h3>\n<p>\n    A foreign judgment cannot be enforced if the case relates to:\n  <\/p>\n<ul>\n<li>real estate located in the UAE,<\/li>\n<li>local employment relationships,<\/li>\n<li>local commercial agency matters.<\/li>\n<\/ul>\n<p>\n    In such matters, the UAE courts have exclusive jurisdiction.\n  <\/p>\n<h3>6.
