Segons la jurisprud\u00e8ncia recent, l'abast per aplicar aquesta disposici\u00f3 per analogia sembla limitat. La reclamaci\u00f3 de compensaci\u00f3 del franquiciatari d'una gran empresa sense nom va ser desestimada \u00edntegrament (BGH VII ZR 109\/13). El Tribunal Superior Regional de Hamm va arribar a una conclusi\u00f3 similar (OLG Hamm 18 U 35\/13). L'acord de llic\u00e8ncia tractat en la denominada sent\u00e8ncia \u201cJoop!\u201d (BGH I ZR 3\/09, 29 d'abril de 2010) pot entendre's igualment, en el context d'una relaci\u00f3 contractual de tipus franqu\u00edcia, en el sentit que un dret a indemnitzaci\u00f3 nom\u00e9s pot sorgir quan el franquiciat distribueix productes fabricats o subministrats pel franquiciador.<\/p>\n<p>Tanmateix, la q\u00fcesti\u00f3 encara no s'ha resolt de manera concloent.
