Segons la sent\u00e8ncia, en aquell moment la relaci\u00f3 laboral ja no existia.<\/p>\n<p>Tot i que no hi havia cap acord de rescissi\u00f3 per escrit al dossier del cas, era indiscutible que l'empresari demandat havia donat de baixa el demandant, l'exdirector general, davant les autoritats de la seguretat social, i que aquest ho havia acceptat sense cap objecci\u00f3. En un litigi de dret de fam\u00edlia, l'exdirector general tamb\u00e9 va declarar que s'havia incorporat a una altra empresa.<\/p>\n<p>Sobre aquesta base, el tribunal va considerar que calia assumir que el contracte de treball del director general s'havia extingit per acord mutu.
