Un canvi clau \u00e9s la introducci\u00f3 d'un nou procediment d'invalidesa, modelat segons el procediment de cancel\u00b7laci\u00f3 previst a la Llei alemanya de marques (article 53 MarkenG).<\/p>\n<p>L'antiga Llei de patents de disseny no preveia un procediment d'aquest tipus. Els fabricants o comerciants nom\u00e9s podien impugnar un disseny registrat mitjan\u00e7ant procediments judicials davant dels tribunals regionals (article 33.2 de la Llei de patents de disseny). Aix\u00f2 implicava un risc econ\u00f2mic considerable, tant perqu\u00e8 la representaci\u00f3 legal davant dels tribunals regionals era obligat\u00f2ria com perqu\u00e8, en cas de derrota, la part perdedora havia d'assumir no nom\u00e9s les despeses judicials sin\u00f3 tamb\u00e9 les de la part contr\u00e0ria.<br \/>\nAmb la introducci\u00f3 de la nova Secci\u00f3 34a de la Llei alemanya de disseny, ara \u00e9s suficient presentar una sol\u00b7licitud raonada per escrit a l'Oficina Alemanya de Patents i Marques Comercials. Els costos continuen sent assumibles i ara es determinen d'acord amb la Llei de costos de patents i la Llei de remuneraci\u00f3 dels advocats alemanys (article 34a, par\u00e0graf 6, de la Llei de disseny).<\/p>\n<p>Una de les conclusions que es poden extreure de la nova Llei de Disseny Alemanya \u00e9s que les parts afectades per un disseny registrat ara finalment disposen d'una alternativa m\u00e9s senzilla i significativament m\u00e9s rendible per sol\u00b7licitar la cancel\u00b7laci\u00f3 d'un disseny registrat.<\/p>","protected":false},"excerpt":{"rendered":"<p>With effect from 1 January 2014, the former German Design Patent Act was abolished and renamed as the new German Design Act.
