The Government Decree issued on 31 March contains provisions applicable during the state of emergency concerning various procedural law matters. Below we summarise its main points relating to court proceedings.<\/p>\n
One of the most important issues clarified by the decree is that, unless otherwise provided, the state of emergency does not affect the running of procedural deadlines. This means that the statutory time limits applicable to procedural acts must still be observed.<\/p>\n
In contentious court proceedings, the preparatory phase of the litigation must be conducted without a preparatory hearing. The court may not hold such a hearing even if requested by the parties. However, where necessary, the parties may be required to submit additional written statements, and, if a personal hearing is necessary, it may be conducted through an electronic communication device capable of verifying the identity of the participant.<\/p>\n
Where a procedural act requiring personal attendance cannot be carried out electronically, the period lasting until the obstacle is removed or until the state of emergency ends is not counted towards the applicable procedural deadlines.<\/p>\n
In contentious proceedings, substantive hearings must also be conducted through electronic means.<\/p>\n
Furthermore, in such proceedings, the parties may jointly request the suspension of the proceedings an unlimited number of times.<\/p>\n
Where an interim measure has been ordered before the commencement of litigation, the time limit set by the court for initiating the action begins on the day following the end of the state of emergency.<\/p>\n
If service by public notice becomes necessary, the proceedings are interrupted until the reason requiring service by public notice ceases to exist or until the end of the state of emergency.<\/p>\n
