Dezember 2019 k\u00f6nnen mit der k\u00fcnftigen \u00dcberf\u00fchrung von Gefangenen nach Ungarn besonderen Auflagen von Haftbedingungen verbunden werden.<br \/>\nIn einem Auslieferungsverfahren eines ungarischen Gefangenen in Deutschland an Ungarn wurde er\u00f6rtert, dass dies wegen der \u00dcberf\u00fcllung des ungarischen Gef\u00e4ngnissystems ein Versto\u00df gegen die \u00f6ffentlichen Ordnung darstelle und daher die \u00dcbergabe abgelehnt werden m\u00fcsse.<\/p>\n<p>Die Staatsanwaltschaft daher wurde angewiesen, eine genaue Untersuchung zum Zustand ungarischer Haftbedingungen durchzuf\u00fchren. Dar\u00fcber hinaus wurde beschlossen, dass die deutschen Beh\u00f6rden, nach Auslieferung des Gefangenen, den Zustand seiner Inhaftierung \u00fcberpr\u00fcfen sollten.<\/p>\n<p>Dieser Fall stellt einen Pr\u00e4zedenzfall dar, da die \u00dcbergabe innerhalb der Europ\u00e4ischen Union ein fast vollst\u00e4ndig entpolitisierter und automatisierter Prozess ist. Wenn ein Mitgliedstaat die Rechtsstaatlichkeit eines anderen Mitgliedstaats pr\u00fcft, wird das grundlegende Vertrauen dieses Staates untergraben.<\/p>\n<p>Angesichts unserer vorgebrachten Argumente ist es in diesem Fall jedoch erforderlich, die Situation in ungarischen Gef\u00e4ngnissen zu untersuchen, nachdem Ungarn dem Europarat unter anderem keine Berichte \u00fcber die Haftbedingungen vorgelegt hatte.<\/p>\n<p>Unsere Kanzlei fungierte in diesem Fall als Verteidiger des ungarischen Betroffenen.<\/p>","protected":false},"excerpt":{"rendered":"<p>According to an order of the Higher Regional Court of Nuremberg dated 23 December 2019, future transfers of prisoners to Hungary may be made subject to specific requirements concerning detention conditions.
