Online sports betting providers from other EU Member States are already at the starting line: Hungary is abolishing the state monopoly on the online sports betting market and, from 1 January 2023, will allow free market access for providers from the European Economic Area.
So, will everything be simple now?
In gambling law, too, prevention is better than cure. Compared with the regulations of other Member States, the Hungarian licensing procedure is complex and lengthy. The competent authority is the Supervisory Authority for Regulatory Affairs.
In Hungary, gambling law is regulated by two statutes: the Gambling Act and the Concessions Act. Since the introduction of the monopoly in 2014, the organisation of gambling has been treated as a state monopoly. This regulation raised numerous legal questions in light of the fundamental freedoms of the European Union. After the Court of Justice of the European Union found the Gambling Act to be incompatible with EU law, the Hungarian Parliament adopted an amendment to the Gambling Act, which enters into force on 1 January 2023 and brings the long-awaited market liberalisation.
