We advised on the review of a high-value contract concerning the production and distribution of porn and other adult content involving a performer closely resembling a well-known US celebrity. The contract not only relied on the performer’s visual likeness but also explicitly referred to the celebrity by their given name.
The matter raised complex legal issues relating to personality rights, use of likeness, and the permissible extent of referencing identifiable individuals in a commercial context.
