What is the judicial recess?<br \/>\nIn Hungary, the judicial recess takes place every year from 15 July to 20 August, as well as during the winter period from 24 December to 1 January. Judges and court staff are generally on their regular annual leave during these periods, meaning that the courts and the administration of justice usually operate in a \u201creduced mode\u201d. In certain cases, the recess may also suspend the running of procedural deadlines.<\/p>\n<p>2. Does criminal justice also come to a standstill?<br \/>\nNo. The judicial recess primarily affects civil proceedings. Criminal judges may, of course, also typically take leave during this period, but this does not affect deadlines in criminal cases. Hearings are generally not scheduled for this period, but arrest, house arrest and similar measures cannot, of course, be avoided merely because of the heat or holiday absences. In criminal matters, other urgent issues continue to be decided as well.<\/p>\n<p>3. Do all deadlines stop during this period?<br \/>\nNo. Even in civil proceedings, favourable rules concerning the calculation of deadlines apply only as a general rule. However, in expedited matters, such as applications for interim measures or press rectification actions, as well as in enforcement-related litigation and certain non-contentious proceedings, everything proceeds as usual. For judgment debtors, the bad news is that enforcement proceedings continue in the ordinary course.<\/p>\n<p>4. What does it mean for a deadline to be \u201csuspended\u201d?<br \/>\nIn cases actually affected by the judicial recess, if a deadline set in months or years would expire during the judicial recess, the deadline will expire on the corresponding day of the following month, matching the day on which the deadline began. For deadlines set in days, the days of the judicial recess must be disregarded when calculating the deadline.<\/p>\n<p>5. Do lawyers also stop working during this period?<br \/>\nNo. Although most lawyers also tend to take their holidays during this period, the legal profession as a whole does not come to a standstill, even in matters where no visible work appears to be taking place on the part of the courts.<\/p>\n<p>+ 1.
