Restrictions at the road crossing between \u00c1gfalva and the Austrian municipality of Schattendorf, known in Hungarian as Somfalva, raised questions of EU law beyond their impact on daily commuting. NZP NAGY LEGAL brought a damages claim in Austria in connection with the municipal measure. The Eisenstadt Regional Court dismissed our claim at first instance; according to the subsequent press report, the judgment was not yet final at that time.<\/p>\n
On 1 March 2023, the municipality of Schattendorf closed the road crossing towards \u00c1gfalva. The decision was justified by the burden of commuter traffic passing through the village. The restriction was subsequently followed by an access control system using individual identifiers, which began operating on 3 July 2023. Motor vehicle access thus became conditional on obtaining a permit and purchasing an identification sticker.<\/p>\n
The subsequent developments reported in 2026 showed that the opportunity to obtain the EUR 160 sticker had not become generally available to permanent residents of \u00c1gfalva: only a small number had received permission, and delays in processing applications were also reported. Those denied motor vehicle access therefore had to choose another means of transport or take an alternative route. The dispute came to concern not only the restriction itself, but also the permit criteria and the additional costs borne by those affected.<\/p>\n
Our firm took up the matter following earlier press coverage of the restrictions at the border crossing and subsequently filed a damages claim against the municipality of Schattendorf, relying on the loss we had ourselves incurred as a result of the detour. In our legal assessment, making access conditional on payment and an individual permit, together with the criteria applied in granting permits, warranted scrutiny under EU law.<\/p>\n
A central element of our argument was the Schengen framework governing the removal of obstacles to road traffic at internal borders. In our view, it was necessary to examine whether the restriction imposed through physical barriers genuinely served road safety objectives or was primarily intended to reduce commuter traffic. This represents the legal argument we advanced in the proceedings; it is not a final judicial finding that the restriction infringed EU law.<\/p>\n
Following a hearing in late November, the Eisenstadt Regional Court dismissed our damages claim at first instance. Speaking on behalf of our firm, M\u00e1t\u00e9 Ruzicska disputed the court\u2019s assessment of the legal issues, particularly the extent to which the installation of a physical barrier could be considered separately from the lawfulness of the restriction on passage.<\/p>\n
At the time of the 2026 report, the judgment was not yet final. The sources discussed do not establish whether an appeal was subsequently lodged or any further decision was issued. Coordinated pursuit of damages claims by other affected parties was raised as a possible next step, rather than as proceedings already commenced or an avenue with a guaranteed outcome.<\/p>\n
The \u00c1gfalva\u2013Schattendorf case illustrates how a local traffic measure can intersect with EU law and the pursuit of claims in another Member State. In this dispute, our firm brought proceedings before an Austrian court, relying in part on arguments under EU law.
