The 34th amendment to the Austrian Road Traffic Regulations introduced a drastic tightening of measures against speeders. Since 1 March 2024, speeding drivers face not only the withdrawal of their driving licence, but also further, more severe penalties, which are imposed in several stages.<\/p>\n
First, drivers who exceed the speed limit by more than 60 km\/h in built-up areas or by more than 70 km\/h outside built-up areas may have their vehicles seized. If drivers are stopped again for significantly excessive speeding despite repeated prior warnings, the authorities are entitled to permanently confiscate and auction the vehicles.<\/p>\n
In cases of extreme speeding, however, a single excessive speeding offence may also lead to the loss of the vehicle.
\nAs soon as the permitted maximum speed is exceeded by more than 80 km\/h in built-up areas or by more than 90 km\/h outside built-up areas, drivers must expect the \u201cforfeiture\u201d of their vehicles from the outset. Forfeiture means the permanent confiscation of the vehicle. The forfeiture procedure is structured in several stages. Sections 99a and 99b of the Austrian Road Traffic Regulations must be distinguished in this regard. Under Section 99a, road traffic enforcement officers may initially seize vehicles provisionally if their drivers exceed the speed limit by more than 60 km\/h in built-up areas or by more than 70 km\/h outside built-up areas. As a next step, it is at the discretion of the district administrative authority whether to initiate forfeiture proceedings against the driver. Under Section 99b, the authority must order the seizure by administrative decision. In the case of repeat offenders, forfeiture proceedings will in any event be initiated. According to Section 7(3) nos. 3 and 4 of the Driving Licence Act, the purpose of seizure is to prevent \u201cparticularly dangerous circumstances\u201d. By contrast, where drivers exceed the speed limit by more than 80 km\/h in built-up areas or by more than 90 km\/h outside built-up areas, the district administrative authority proceeds from the outset with the measure of vehicle forfeiture. In addition to forfeiture, a monetary fine may also be imposed.<\/p>\n
However, even the newly introduced tightening of the Road Traffic Regulations may not interfere with the property rights of third parties. Vehicles that are not owned by the driver may neither be seized nor auctioned.<\/p>","protected":false},"excerpt":{"rendered":"
