A v\u00e1dirat szerint a megnevezett szem\u00e9lyek \u00e1llamellenes b\u0171ncselekm\u00e9nyeket k\u00f6vettek el, polg\u00e1ri l\u00e9gi j\u00e1rm\u0171vet (j\u00e1rm\u0171veket) semmis\u00edtettek meg, valamint gyilkoss\u00e1got k\u00f6vettek el.\n  <\/p>\n<p>\n    A v\u00e1d legf\u0151bb pontja az els\u0151 v\u00e1dpont: \u00f6sszeesk\u00fcv\u00e9s amerikai \u00e1llampolg\u00e1rok meggyilkol\u00e1s\u00e1ra (18 U.S.C. \u00a7 2332(b)(2)). A v\u00e1dirat szerint 1996 janu\u00e1rja \u00e9s \u00e1prilisa k\u00f6z\u00f6tt, az Egyes\u00fclt \u00c1llamok ter\u00fclet\u00e9n k\u00edv\u00fcl a v\u00e1dlottak tudatosan \u00e9s sz\u00e1nd\u00e9kosan meg\u00e1llapodtak abban, hogy meg\u00f6lik az amerikai \u00e1llampolg\u00e1rokat.\n  <\/p>\n<p>\n    A v\u00e1dirat kifejezetten kimondja, hogy az \u00f6sszeesk\u00fcv\u0151 csoport c\u00e9lja az volt, hogy h\u00edrszerz\u00e9si inform\u00e1ci\u00f3k felhaszn\u00e1l\u00e1s\u00e1val lel\u0151j\u00e9k a BTTR fegyvertelen polg\u00e1ri rep\u00fcl\u0151g\u00e9peit, ezzel megf\u00e9leml\u00edtve, elrettentve \u00e9s megtorl\u00e1st gyakorolva a kubai lakoss\u00e1g \u00e9s a sz\u00e1m\u0171zet\u00e9sben \u00e9l\u0151 k\u00f6z\u00f6ss\u00e9g tev\u00e9kenys\u00e9gei ellen.\n  <\/p>\n<p>Ezt az \u00e1ll\u00edt\u00e1st t\u00f6bbek k\u00f6z\u00f6tt a k\u00f6vetkez\u0151k t\u00e1masztj\u00e1k al\u00e1:<\/p>\n<ul>\n<li>a BTTR szervezetbe val\u00f3 titkos be\u00e9p\u00fcl\u00e9s Miamiban,<\/li>\n<li>a parancsnoki l\u00e1ncon kereszt\u00fcl kiadott katonai felk\u00e9sz\u00fcl\u00e9si \u00e9s hadm\u0171veleti parancsok,<\/li>\n<li>valamint az 1996. febru\u00e1r 24-\u00e9n v\u00e9grehajtott t\u00e1mad\u00e1s, amelynek sor\u00e1n k\u00e9t rep\u00fcl\u0151g\u00e9pet l\u00e9g-l\u00e9g rak\u00e9t\u00e1kkal (AAM-ekkel) l\u0151ttek le a nemzetk\u00f6zi l\u00e9gt\u00e9rben, ami n\u00e9gy ember hal\u00e1l\u00e1t okozta.<\/li>\n<\/ul>\n<p>A fennmarad\u00f3 v\u00e1dpontok a k\u00f6vetkez\u0151k:<\/p>\n<ul>\n<li>2\u20133. v\u00e1dpont: l\u00e9gi j\u00e1rm\u0171 megsemmis\u00edt\u00e9se (18 U.S.C. \u00a7 32, \u00a7 34; 49 U.S.C. \u00a7 46501), minden egyes l\u00e9gi j\u00e1rm\u0171re vonatkoz\u00f3an k\u00fcl\u00f6n v\u00e1dat emeltek,<\/li>\n<li>4\u20137. v\u00e1dpont: gyilkoss\u00e1g (18 U.S.C. \u00a7 1111, \u00a7 3238, \u00a7 2), minden \u00e1ldozat eset\u00e9ben k\u00fcl\u00f6n v\u00e1dat emeltek.<\/li>\n<\/ul>\n<p>\n    Ez a v\u00e1dszerkezet lehet\u0151v\u00e9 teszi az \u00fcgy\u00e9szs\u00e9g sz\u00e1m\u00e1ra, hogy mind a b\u0171ncselekm\u00e9nyek \u00f6sszeesk\u00fcv\u00e9sszer\u0171 jelleg\u00e9t, mind az egyes gyilkoss\u00e1gokat, valamint a polg\u00e1ri rep\u00fcl\u0151g\u00e9pek megsemmis\u00edt\u00e9s\u00e9t is figyelembe vegye.\n  <\/p>\n<h2>Mi az alapja az Egyes\u00fclt \u00c1llamok extraterritori\u00e1lis joghat\u00f3s\u00e1g\u00e1nak?<\/h2>\n<p>\n    Az amerikai joghat\u00f3s\u00e1g legf\u0151bb jogalapja az 18 U.S.C. \u00a7 2332(b) szakasz, amely kifejezetten b\u0171ncselekm\u00e9nynek min\u0151s\u00edti az amerikai \u00e1llampolg\u00e1rok k\u00fclf\u00f6ld\u00f6n t\u00f6rt\u00e9n\u0151 meggyilkol\u00e1s\u00e1t, illetve az erre ir\u00e1nyul\u00f3 \u00f6sszeesk\u00fcv\u00e9st. Hasonl\u00f3 rendelkez\u00e9s tal\u00e1lhat\u00f3 a magyar B\u00fcntet\u0151 T\u00f6rv\u00e9nyk\u00f6nyv 3. \u00a7 (2) bekezd\u00e9s\u00e9nek b) pontj\u00e1ban is, amely el\u0151\u00edrja, hogy a magyar b\u00fcntet\u0151jog alkalmazand\u00f3 a nem magyar \u00e1llampolg\u00e1rok \u00e1ltal k\u00fclf\u00f6ld\u00f6n magyar \u00e1llampolg\u00e1rok ellen elk\u00f6vetett cselekm\u00e9nyekre, amennyiben a magatart\u00e1s a magyar jog szerint b\u00fcntetend\u0151.\n  <\/p>\n<p>Ez a keretrendszer t\u00f6bb joghat\u00f3s\u00e1gi elven alapul:<\/p>\n<ul>\n<li><strong>A passz\u00edv szem\u00e9lyis\u00e9g elve<\/strong> \u2013 az illet\u00e9kess\u00e9g az \u00e1ldozatok amerikai \u00e1llampolg\u00e1rs\u00e1g\u00e1n alapul;<\/li>\n<li><strong>A v\u00e9delem elve<\/strong> \u2013 a b\u0171ncselekm\u00e9ny helysz\u00edne vagy az elk\u00f6vet\u0151 \u00e1llampolg\u00e1rs\u00e1ga nem meghat\u00e1roz\u00f3 t\u00e9nyez\u0151, \u00edgy az \u00e1llamnak jog\u00e1ban \u00e1ll k\u00fclf\u00f6ldi \u00e1llampolg\u00e1rok \u00e1ltal k\u00fclf\u00f6ld\u00f6n elk\u00f6vetett cselekm\u00e9nyeket is b\u00fcntet\u0151elj\u00e1r\u00e1s al\u00e1 vonni, amennyiben az \u00e1llami \u00e9rdekek s\u00e9r\u00fclnek \u2013 jellemz\u0151en az \u00e1llam ellen elk\u00f6vetett b\u0171ncselekm\u00e9nyek, p\u00e9ld\u00e1ul a k\u00e9mked\u00e9s eset\u00e9ben;<\/li>\n<li><strong>A ter\u00fcleti kiz\u00e1r\u00f3lagoss\u00e1g elve<\/strong> \u2013 az Egyes\u00fclt \u00c1llamokban lajstromozott l\u00e9gi j\u00e1rm\u0171vekre vonatkoz\u00f3 joghat\u00f3s\u00e1g; az 49 U.S.C. \u00a7 46501 kifejezetten meghat\u00e1rozza a \u201cl\u00e9gi j\u00e1rm\u0171vekre vonatkoz\u00f3 k\u00fcl\u00f6nleges joghat\u00f3s\u00e1g\u201d fogalm\u00e1t.\u201d<\/li>\n<\/ul>\n<p>\n    Fontos tov\u00e1bb\u00e1 megjegyezni, hogy az 18 U.S.C. \u00a7 2332(d) szerint a ter\u00fcleten k\u00edv\u00fcli b\u0171ncselekm\u00e9nyek miatti elj\u00e1r\u00e1s megind\u00edt\u00e1s\u00e1hoz sz\u00fcks\u00e9ges, hogy az igazs\u00e1g\u00fcgy-miniszter meg\u00e1llap\u00edtsa: a b\u0171ncselekm\u00e9ny c\u00e9lja egy korm\u00e1ny vagy a polg\u00e1ri lakoss\u00e1g megf\u00e9leml\u00edt\u00e9se, k\u00e9nyszer\u00edt\u00e9se vagy megtorl\u00e1sa volt. A magyar B\u00fcntet\u0151 T\u00f6rv\u00e9nyk\u00f6nyvh\u00f6z hasonl\u00f3an ez a k\u00f6vetelm\u00e9ny is azt mutatja, hogy sz\u00e1mos \u00e1llam a ter\u00fclet\u00e9n k\u00edv\u00fcl keletkez\u0151 b\u00fcntet\u0151jogi ig\u00e9nyeket nem csup\u00e1n joghat\u00f3s\u00e1gi k\u00e9rd\u00e9sk\u00e9nt kezeli, hanem olyan \u00fcgyekk\u00e9nt, amelyek k\u00fclpolitikai \u00e9s szuverenit\u00e1si szempont\u00fa vizsg\u00e1latot ig\u00e9nyelnek.\n  <\/p>\n<p>\n    V\u00e9g\u00fcl az 18 U.S.C. \u00a7 3238 hat\u00e1rozza meg az ilyen \u00fcgyek b\u00edr\u00f3s\u00e1gi illet\u00e9kess\u00e9g\u00e9t. \u00c1ltal\u00e1nos szab\u00e1lyk\u00e9nt az elj\u00e1r\u00e1st abban a ker\u00fcletben kell megind\u00edtani, ahol a v\u00e1dlottat letart\u00f3ztatt\u00e1k vagy el\u0151sz\u00f6r el\u0151\u00e1ll\u00edtott\u00e1k. Ha ez m\u00e9g nem t\u00f6rt\u00e9nt meg \u2013 mint a jelen \u00fcgyben \u2013, a v\u00e1diratot Washington, D.C.-ben lehet beny\u00fajtani, amennyiben a v\u00e1dlottaknak nincs lak\u00f3hely\u00fck az Egyes\u00fclt \u00c1llamokban.\n  <\/p>\n<h2>Az \u00e1llami szuverenit\u00e1s \u00e9s immunit\u00e1s k\u00e9rd\u00e9sei<\/h2>\n<p>\n    Minden ilyen jelleg\u0171 eset fesz\u00fclts\u00e9get kelt az \u00e1llami szuverenit\u00e1s \u00e9s az egy\u00e9ni b\u00fcntet\u0151jogi felel\u0151ss\u00e9g k\u00f6z\u00f6tt.\n  <\/p>\n<h3>1. \u00c1llami szuverenit\u00e1s<\/h3>\n<p>\n    A nemzetk\u00f6zi jog egyik alapelve, hogy egy \u00e1llam els\u0151sorban a saj\u00e1t ter\u00fclet\u00e9n gyakorolja szuverenit\u00e1s\u00e1t. A v\u00e1dirat azonban arra az \u00e1ll\u00edt\u00e1sra alapul, hogy a lel\u0151\u00e9s a nemzetk\u00f6zi l\u00e9gt\u00e9rben t\u00f6rt\u00e9nt, ami cs\u00f6kkenti a kiz\u00e1r\u00f3lagos ter\u00fcleti joghat\u00f3s\u00e1g jelent\u0151s\u00e9g\u00e9t.\n  <\/p>\n<p>\n    Ugyanakkor a cselekm\u00e9nyeket \u00e1ll\u00edt\u00f3lag \u00e1llami szervek \u2013 k\u00f6zt\u00fck a hadsereg \u00e9s a titkosszolg\u00e1latok \u2013 k\u00f6vett\u00e9k el, ami hagyom\u00e1nyosan a nemzetk\u00f6zi jog szerinti \u00e1llami felel\u0151ss\u00e9g k\u00e9rd\u00e9s\u00e9t vetn\u00e9 fel. Az amerikai elj\u00e1r\u00e1s ezzel szemben sz\u00e1nd\u00e9kosan az egy\u00e9ni b\u00fcntet\u0151jogi felel\u0151ss\u00e9gre \u00f6sszpontos\u00edt.\n  <\/p>\n<h3>2. Az \u00e1llami tiszts\u00e9gvisel\u0151k mentess\u00e9ge<\/h3>\n<p>\n    A hivatalban l\u00e9v\u0151 \u00e1llamvezet\u0151k \u2013 p\u00e9ld\u00e1ul az \u00e1llam- vagy korm\u00e1nyf\u0151k \u2013 mentelmi joga a nemzetk\u00f6zi kapcsolatok z\u00f6kken\u0151mentes m\u0171k\u00f6d\u00e9s\u00e9nek biztos\u00edt\u00e1s\u00e1t \u00e9s a szuver\u00e9n egyenl\u0151s\u00e9g v\u00e9delm\u00e9t szolg\u00e1lja. A funkcion\u00e1lis mentess\u00e9g ezzel szemben azon az elven alapul, hogy egy \u00e1llam b\u00edr\u00f3s\u00e1gai nem \u00edt\u00e9lkezhetnek egy m\u00e1sik \u00e1llam szuver\u00e9n cselekm\u00e9nyei felett.
