A jogkeres\u0151 k\u00f6z\u00f6ns\u00e9g pedig sokszor olyan helyzettel tal\u00e1lkozik, hogy m\u00e9g a t\u00e1rgyal\u00f3teremig sem siker\u00fcl eljutnia, a b\u00edr\u00f3s\u00e1g ugyanis a keresetlevel\u00e9t szinte automatikusan visszautas\u00edtja.<\/p>\n<p>Az \u00faj Pp. az indokol\u00e1sa szerint szlov\u00e9n \u00e9s litv\u00e1n perjogi hagyom\u00e1nyokra \u00e9p\u00edt. A mi \u00e1ll\u00e1pontunk szerint c\u00e9lszer\u0171bb lett volna a magyar szab\u00e1lyoz\u00e1s alapj\u00e1t k\u00e9pez\u0151 (\u00e9s a kor\u00e1bbi Pp-vel sokszor \u00a7-sz\u00e1mban is megegyez\u0151) n\u00e9met ZPO el\u0151\u00edr\u00e1sait \u00e1t\u00fcltetni. Ez els\u0151sorban a koncentr\u00e1ltabb pervitelt \u00e9s a (val\u00f3di) anyagi pervezet\u00e9st seg\u00edthette volna el\u0151. Ha a jogalkot\u00f3 mindenk\u00e9pp ragaszkodott volna az osztott perszerkezethez (perfelv\u00e9teli \u00e9s \u00e9rdemi t\u00e1rgyal\u00e1s), \u00fagy lehet\u0151s\u00e9g lett volna az osztr\u00e1k elj\u00e1r\u00e1si t\u00f6rv\u00e9nyb\u0151l mer\u00edteni. A jogalkot\u00f3 ezzel szemben teljesen \u00e9letidegen szab\u00e1lyokat vezetett be. A gyakorlatban ezek pedig nem a jogvita gyors lez\u00e1r\u00e1s\u00e1t t\u0171nnek szolg\u00e1lni (pl. mert a b\u00edr\u00f3 egyezs\u00e9gk\u00f6t\u00e9sre t\u00f6rekszik), hanem \u00fagy t\u0171nik, hogy a b\u00edr\u00e1k a b\u00fcrokratikus technikai r\u00e9szletszab\u00e1lyokon lovagolva l\u00e1tszanak akad\u00e1lyozni az effekt\u00edv jog\u00e9rv\u00e9nyes\u00edt\u00e9st.<\/p>\n<p>Ennek legl\u00e1tv\u00e1nyosabb p\u00e9ld\u00e1ja, hogy egyes \u201evar\u00e1zsig\u00e9k\u201d (v\u00e9lt vagy val\u00f3s) kifelejt\u00e9se miatt m\u00e9g a keresetind\u00edt\u00e1s sem lehets\u00e9ges, mert a b\u00edr\u00f3s\u00e1g m\u00e1r a keresetlevelet visszautas\u00edtja. Ezen a ponton \u00e1ll\u00e1spontunk szerint s\u00falyos f\u00e9lre\u00e9rt\u00e9sek \u00e9rv\u00e9nyes\u00fclnek a b\u00edr\u00f3s\u00e1g r\u00e9sz\u00e9r\u0151l. A b\u00edr\u00e1k ugyanis \u2013 rem\u00e9lhet\u0151leg csak ezen a kezdeti ponton \u2013 nem l\u00e1tszanak k\u00e9pesnek megk\u00fcl\u00f6nb\u00f6ztetni a megengedhet\u0151s\u00e9g (Zul\u00e4ssigkeit) \u00e9s az alaposs\u00e1g (Begr\u00fcndetheit) k\u00e9rd\u00e9s\u00e9t. A keresetlev\u00e9lnek ugyanis nem sz\u00fcks\u00e9ges \u00f6nmag\u00e1ban mindent bizony\u00edtani (ellenkez\u0151 esetben nem lenne \u00e9rtelme a vitat\u00e1s \u00e9s a nem vitat\u00e1s int\u00e9zm\u00e9ny\u00e9nek), hanem hat\u00e1rozott \u00e9s \u00f6sszeszedett t\u00e9ny- \u00e9s bizony\u00edt\u00e9kel\u0151ad\u00e1sra (schl\u00fcssiger Klagevortrag).<\/p>\n<p>M\u00e1r \u00f6nmag\u00e1ban az \u00faj int\u00e9zm\u00e9nyekkel kapcsolatos \u00e1ltal\u00e1nosan ismert nyelveken (angol, n\u00e9met) rendelkez\u00e9sre \u00e1ll\u00f3 jogirodalom el\u00e9rhet\u0151s\u00e9ge miatt is javasolt lett volna klasszikus, nem pedig egzotikus k\u00f3dexekb\u0151l mer\u00edteni. Ekkor ugyanis lehet\u0151s\u00e9g lett volna az ir\u00e1nyad\u00f3 k\u00fclf\u00f6ldi jogirodalom \u00e9s eseti d\u00f6nt\u00e9sek \u00e9rdemi vizsg\u00e1lat\u00e1ra a magyar jog\u00e9rtelmez\u00e9s fejleszt\u00e9se c\u00e9lj\u00e1b\u00f3l. Azt ugyanis kev\u00e9sbe l\u00e1tjuk val\u00f3sz\u00edn\u0171nek, hogy  a magyar b\u00edr\u00f3s\u00e1g litv\u00e1n vagy szlov\u00e9n nyelv\u0171 komment\u00e1rt fog forgatni eyes k\u00e9rd\u00e9sek \u00e9rtelmez\u00e9se c\u00e9lj\u00e1b\u00f3l.<\/p>\n<p>\u00d6sszess\u00e9g\u00e9ben teh\u00e1t azt tudjuk javasolni minden megl\u00e9v\u0151 \u00e9s jelenlegi \u00fcgyfel\u00fcnknek, hogy minden esetben, amikor a v\u00e1laszt\u00e1s lehet\u0151s\u00e9ge fenn\u00e1ll (pl. k\u00fclf\u00f6ldi sz\u00e1ll\u00edt\u00e1sok, t\u00f6bb fi\u00f3ktelep), egyel\u0151re k\u00fclf\u00f6ldi b\u00edr\u00f3s\u00e1g el\u0151tt ind\u00edtson pert.
