Access to the Court is governed by strict admissibility and procedural requirements. We advise and represent applicants from the initial assessment of a potential claim through the proceedings before the Court, with particular attention to admissibility, deadlines and the presentation of a complete application.<\/p>\n<h2>Who we help<\/h2>\n<p style=\"font-weight: 400;\">We assist individuals, families and other eligible applicants who believe that conduct attributable to a Contracting State has violated rights protected by the Convention. Matters may concern, among other issues:<\/p>\n<ul>\n<li>the right to a fair hearing and unreasonable delay in proceedings;<\/li>\n<li>liberty and security, including allegedly unlawful detention;<\/li>\n<li>private and family life;<\/li>\n<li>freedom of expression, religion, assembly or association;<\/li>\n<li>protection of property;<\/li>\n<li>discrimination in the enjoyment of Convention rights; and<\/li>\n<li>serious allegations engaging the right to life or the prohibition of torture or inhuman or degrading treatment.<\/li>\n<\/ul>\n<h2>Admissibility: the gateway to the Court<\/h2>\n<p style=\"font-weight: 400;\">The Court considers admissibility before determining whether a Convention right has been violated. A complaint can therefore fail without examination of its merits if the admissibility criteria are not satisfied. Our initial review identifies the procedural and jurisdictional questions that may determine whether an application can proceed.<\/p>\n<ul>\n<li>Victim status: whether the applicant can show that they are directly affected, or otherwise qualify as a victim under the Convention.<\/li>\n<li>Jurisdiction: whether the complaint falls within the Court\u2019s personal, territorial, temporal and subject-matter jurisdiction.<\/li>\n<li>Exhaustion of domestic remedies: whether available and effective remedies have been used and the Convention complaint has been raised domestically in substance.<\/li>\n<li>Time limit: whether the application can be lodged within four months of the relevant final domestic decision.<\/li>\n<li>Substantiation: whether the facts, supporting documents and legal argument disclose an arguable Convention complaint.<\/li>\n<li>Other admissibility issues: whether the matter has already been examined internationally, is substantially the same as another application, is anonymous, is abusive, is manifestly ill-founded, or falls within another ground of inadmissibility.<\/li>\n<\/ul>\n<h2>Exhaustion of domestic remedies<\/h2>\n<p style=\"font-weight: 400;\">The European Court of Human Rights is not a further level of appeal against national judgments. Ordinarily, applicants must first give the domestic authorities an opportunity to address the alleged violation through remedies that are available and effective. The analysis is case-specific. It may involve identifying the correct procedural route, checking whether the Convention issue was raised in substance, and determining whether any further remedy must be pursued before an application is submitted.<\/p>\n<h2>The four-month deadline<\/h2>\n<p style=\"font-weight: 400;\">As a general rule, an individual application must be lodged within four months of the final domestic decision. The four-month period has applied to final domestic decisions given from 1 February 2022. Determining the start date can be complex where there are several sets of proceedings, questions about service or notification, or attempted extraordinary remedies.<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"662\"><strong>Do not leave the assessment until the final days.<\/strong><\/p>\n<p>A complete application requires a signed application form and supporting documents showing, among other matters, exhaustion of domestic remedies and compliance with the time limit. Early review allows the chronology, decisions and evidence to be organised before the deadline expires.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">We review the procedural history, identify the decision likely to trigger the time limit, and prepare a filing plan. Advice is necessarily based on the facts and domestic procedural law of the particular case. Applicants should seek advice promptly rather than assume that a further or extraordinary remedy suspends or restarts the four-month period.<\/p>\n<h2>A complete and procedurally compliant application<\/h2>\n<p style=\"font-weight: 400;\">Rule 47 of the Rules of Court requires an individual application to be made on the Court\u2019s application form and to contain the information requested by the form. The application must include a concise and legible statement of the facts, the alleged Convention violations and the applicant\u2019s compliance with Article 35 \u00a7 1. It must also be signed and accompanied by copies of the relevant decisions and documents. Supplementary details may be appended, subject to the limits set by Rule 47.<\/p>\n<p style=\"font-weight: 400;\">Our work may include:<\/p>\n<ul>\n<li>reviewing the domestic case file and procedural chronology;<\/li>\n<li>advising on victim status, jurisdiction, exhaustion and the four-month rule;<\/li>\n<li>identifying the Convention rights and complaints supported by the record;<\/li>\n<li>preparing the application form and structured supporting submissions;<\/li>\n<li>organising relevant decisions and evidentiary documents;<\/li>\n<li>corresponding with the Registry and responding to procedural directions;<\/li>\n<li>preparing observations on admissibility and merits after communication;<\/li>\n<li>advising on friendly settlement proposals and claims for just satisfaction; and<\/li>\n<li>representing the applicant through the relevant stages of the Strasbourg proceedings.<\/li>\n<\/ul>\n<h2>Cross-border and multilingual cases<\/h2>\n<p style=\"font-weight: 400;\">Applications may involve proceedings in more than one jurisdiction, foreign-language decisions, applicants living outside the respondent State, or records created over several years. We help turn that material into a clear chronology and a focused Convention case, while coordinating documents and legal input across borders where necessary.<\/p>\n<h2>Why early assessment matters<\/h2>\n<p style=\"font-weight: 400;\">A timely assessment can reveal whether additional domestic steps are still required, whether a critical deadline is approaching, and what evidence must be preserved.
