Arazi m\u00fclkiyetini etkileyen sonraki mevzuat de\u011fi\u015fikliklerinin ard\u0131ndan, yat\u0131r\u0131m\u0131n uzun vadede korunmas\u0131 ve geli\u015ftirilmesi amac\u0131yla olu\u015fturulan bir trustee d\u00fczenlemesi \u00fczerinden ilave tar\u0131m arazileri edinildi.<\/p>\n<p style=\"font-weight: 400;\">Taraflar aras\u0131ndaki anla\u015fmaya g\u00f6re, Macaristan\u2019\u0131n Avrupa Birli\u011fi\u2019ne kat\u0131l\u0131m\u0131yla AB vatanda\u015flar\u0131n\u0131n do\u011frudan arazi m\u00fclkiyeti edinmesinin m\u00fcmk\u00fcn h\u00e2le gelmesinin ard\u0131ndan araziler sat\u0131lacak ve sat\u0131\u015f bedeli ortak bir giri\u015fime aktar\u0131lacakt\u0131. Ancak trustee daha sonra arazileri elden \u00e7\u0131kard\u0131 ve sat\u0131\u015f bedelini kendisinde tuttu. Bu durum m\u00fclkiyet haklar\u0131, s\u00f6zle\u015fmesel y\u00fck\u00fcml\u00fcl\u00fckler ve ba\u015fvurulabilecek hukuki yollar bak\u0131m\u0131ndan karma\u015f\u0131k uyu\u015fmazl\u0131klara yol a\u00e7t\u0131.<\/p>\n<p style=\"font-weight: 400;\">Macaristan mahkemeleri nezdinde y\u00fcr\u00fct\u00fclen yarg\u0131lamalarda sonu\u00e7 al\u0131namamas\u0131 ve uygulanabilir i\u00e7 hukuk \u00e7er\u00e7evesinde tazminata h\u00fckmedilmemesinin ard\u0131ndan, Almanya ile Macaristan aras\u0131ndaki ikili yat\u0131r\u0131m anla\u015fmas\u0131 kapsam\u0131nda sa\u011flanan korumalar\u0131 inceledik. Ayr\u0131ca ICSID \u00e7er\u00e7evesinde yat\u0131r\u0131mc\u0131-devlet tahkimine ba\u015fvuru imk\u00e2n\u0131n\u0131 de\u011ferlendirdik.<\/p>\n<p style=\"font-weight: 400;\">Dosyan\u0131n temel hukuki meselelerinden biri, uluslararas\u0131 yat\u0131r\u0131m hukuku ile Avrupa Birli\u011fi hukuku aras\u0131ndaki ili\u015fkiydi. Bu kapsamda \u00f6zellikle Avrupa Birli\u011fi Adalet Divan\u0131\u2019n\u0131n AB i\u00e7i yat\u0131r\u0131m tahkimine ili\u015fkin i\u00e7tihad\u0131n\u0131n sonu\u00e7lar\u0131n\u0131 de\u011ferlendirdik.
