NREA, mevcut Tapu Sicili Kanunu\u2019nun yerini alacak ve Medeni Kanun\u2019un tapu siciline ili\u015fkin h\u00fck\u00fcmlerini de de\u011fi\u015ftirecektir. Bu nedenle, mevcut duruma g\u00f6re 1 \u015eubat 2024 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecek d\u00fczenlemelerin baz\u0131lar\u0131 Macaristan gayrimenkul hukukuna \u00f6nemli yenilikler getirecektir.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">NREA\u2019n\u0131n temel ama\u00e7lar\u0131ndan biri, <strong>mevcut tapu sicili sistemini dijitalle\u015ftirerek<\/strong>daha h\u0131zl\u0131 ve etkin h\u00e2le getirmektir. Kanun koyucu, k\u00e2\u011f\u0131t \u00fczerinde y\u00fcr\u00fct\u00fclen idari i\u015flemleri daha h\u0131zl\u0131 bir elektronik sistemle de\u011fi\u015ftirmeyi hedeflemektedir. <strong>Bu d\u00f6n\u00fc\u015f\u00fcm, otomatik karar verme sisteminin<\/strong>kapsam\u0131n\u0131n geni\u015fletilmesiyle desteklenecektir. Otomatik i\u015flemler \u015fimdiye kadar esas olarak tapu sicili kay\u0131tlar\u0131n\u0131n suretlerinin verilmesiyle s\u0131n\u0131rl\u0131yd\u0131. Yeni Kanun y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011finde sistem di\u011fer kamuya a\u00e7\u0131k elektronik sicillerle entegre edilecektir. B\u00f6ylece belirli durumlarda otomatik karar i\u00e7in gerekli bilgilere do\u011frudan eri\u015filebilecektir. Genel idari usul kurallar\u0131 uyar\u0131nca yetkili makam\u0131n bu t\u00fcr kararlar\u0131 vermesi i\u00e7in kural olarak 24 saate kadar s\u00fcresi olacakt\u0131r.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Yeni Kanun, hukuki i\u015flemlerde <strong>elektronik vek\u00e2letnamelerin<\/strong> kullan\u0131lmas\u0131n\u0131 da te\u015fvik etmektedir. E-hukuk alan\u0131nda \u00f6nc\u00fc b\u00fcrolardan biri olarak biz de bu t\u00fcr elektronik imza yaz\u0131l\u0131mlar\u0131n\u0131 kullan\u0131yoruz. Elektronik vek\u00e2letnameyle yap\u0131lan ba\u015fvurular, insan m\u00fcdahalesine gerek kalmadan daha h\u0131zl\u0131 ve otomatik karar verilmesine imk\u00e2n sa\u011flayabilir. S\u00fcreci h\u0131zland\u0131rmak ve m\u00fcmk\u00fcn oldu\u011funca kolayla\u015ft\u0131rmak amac\u0131yla m\u00fcvekkillerimize nitelikli elektronik imza olu\u015fturmak i\u00e7in kulland\u0131\u011f\u0131m\u0131z yaz\u0131l\u0131m\u0131 da sunuyoruz. B\u00f6ylece s\u00f6zle\u015fmeler elektronik imzayla evden \u00e7\u0131kmadan imzalanabilir.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">H\u00e2len y\u00fcr\u00fcrl\u00fckte olan Macar Medeni Kanunu uyar\u0131nca,<strong> bir ta\u015f\u0131nmaz \u00fczerinde devir ve ipotek hakk\u0131 kurulmas\u0131n\u0131n yasaklanmas\u0131<\/strong> birlikte tesis edilebilmektedir. \u0130potek hakk\u0131 kurulmas\u0131na ili\u015fkin yasa\u011f\u0131n tek ba\u015f\u0131na tesis edilmesi ise m\u00fcmk\u00fcn de\u011fildir. NREA\u2019n\u0131n y\u00fcr\u00fcrl\u00fc\u011fe girmesiyle Medeni Kanun da de\u011fi\u015fecektir. 2024 y\u0131l\u0131ndan itibaren bu haklar\u0131n ba\u011f\u0131ms\u0131z olarak tesis edilmesi m\u00fcmk\u00fcn olacakt\u0131r. Birlikte tesis edilmeleri de m\u00fcmk\u00fcn olmaya devam edecektir. B\u00f6ylece ta\u015f\u0131nmaz\u0131n devrini engellemeyen, ancak ta\u015f\u0131nmaz \u00fczerinde ipotek hakk\u0131 kurulmas\u0131n\u0131 hak sahibinin r\u0131zas\u0131na ba\u011flayan bir yasak da ba\u011f\u0131ms\u0131z olarak tapu siciline tescil edilebilecektir.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Kanun de\u011fi\u015fikli\u011fi, <strong>m\u00fclkiyetin sakl\u0131 tutulmas\u0131<\/strong>kurumunun kapsam\u0131n\u0131 da geni\u015fletmektedir. Mevcut d\u00fczenleme, sat\u0131c\u0131n\u0131n sat\u0131n alma bedeli tamamen \u00f6deninceye kadar m\u00fclkiyet hakk\u0131n\u0131 sakl\u0131 tutmas\u0131na imk\u00e2n vermektedir. De\u011fi\u015fiklikle birlikte al\u0131c\u0131n\u0131n hakk\u0131n\u0131n korunmas\u0131na daha fazla \u00f6nem verilmektedir. Yeni d\u00fczenlemeye g\u00f6re sat\u0131c\u0131, m\u00fclkiyetin sakl\u0131 tutuldu\u011fu s\u00fcre boyunca al\u0131c\u0131n\u0131n r\u0131zas\u0131 olmadan onun ta\u015f\u0131nmaz\u0131 edinme hakk\u0131n\u0131 ihlal edemez. Sat\u0131c\u0131, sat\u0131n alma bedeli \u00f6deninceye kadar m\u00fclkiyet hakk\u0131n\u0131 elinde tutmaya devam eder. Ancak bu s\u00fcre boyunca m\u00fclkiyet hakk\u0131 \u00fczerindeki tasarruf yetkisi s\u0131n\u0131rland\u0131r\u0131l\u0131r.
