Yerel mahkemeler (j\u00e1r\u00e1sb\u00edr\u00f3s\u00e1g), Budape\u015fte\u2019deki il\u00e7e mahkemeleri (ker\u00fcleti b\u00edr\u00f3s\u00e1g), b\u00f6lge mahkemeleri (t\u00f6rv\u00e9nysz\u00e9k) ve Budape\u015fte Ba\u015fkent Mahkemesi (F\u0151v\u00e1rosi T\u00f6rv\u00e9nysz\u00e9k) bu kapsamdad\u0131r. Bu mahkemeler hukuk ve ceza davalar\u0131n\u0131n yan\u0131 s\u0131ra idare hukuku ve i\u015f uyu\u015fmazl\u0131klar\u0131na ili\u015fkin davalara da bakar.<\/li>\n<li><strong><em>\u0130stinaf mahkemeleri<\/em><\/strong>: Budape\u015fte, Debrecen, Szeged, P\u00e9cs ve Gy\u0151r\u2019de bulunan bu mahkemeler, ilk derece mahkemelerinin kararlar\u0131na kar\u015f\u0131 yap\u0131lan ba\u015fvurular\u0131 inceler.<\/li>\n<li><strong><em>Y\u00fcksek Mahkeme<\/em><\/strong>: \u00dclkedeki en y\u00fcksek yarg\u0131 merciidir. Alt derece mahkemelerinin kararlar\u0131n\u0131 inceler ve kendisine yap\u0131lan ba\u015fvurular hakk\u0131nda nihai karar verir.<\/li>\n<\/ul>\n<p>Bunlar\u0131n yan\u0131 s\u0131ra <em>Alkotm\u00e1nyb\u00edr\u00f3s\u00e1g<\/em> (Anayasa Mahkemesi) bulunmaktad\u0131r. Anayasa Mahkemesi, Anayasa\u2019n\u0131n yorumlanmas\u0131 ve kanunlar\u0131n anayasaya uygunlu\u011funa ili\u015fkin meselelerin incelenmesinden sorumludur.<\/p>\n<h5><strong>Macaristan\u2019daki Yarg\u0131lamalarda Neden Bir Avukata \u0130htiya\u00e7 Duyulur?<\/strong><\/h5>\n<p>Avukatlar, hukuk kurallar\u0131 ve yarg\u0131lama usulleri konusunda e\u011fitim alm\u0131\u015f hukuk\u00e7ulard\u0131r. M\u00fcvekkillerine hukuki dan\u0131\u015fmanl\u0131k ve temsil hizmeti sunarlar. Yarg\u0131lama s\u00fcrecinin do\u011fru \u015fekilde y\u00fcr\u00fct\u00fclmesine yard\u0131mc\u0131 olur ve m\u00fcvekkillerinin hak ve menfaatlerini savunurlar.<\/p>\n<p>Macaristan\u2019da ilk derece mahkemelerinde avukatla temsilin zorunlu olup olmad\u0131\u011f\u0131 genellikle davan\u0131n de\u011feri ve konusu gibi unsurlara ba\u011fl\u0131d\u0131r.<\/p>\n<h5 style=\"text-align: center;\"><em>Buna kar\u015f\u0131l\u0131k, s\u0131n\u0131rl\u0131 say\u0131daki istisna d\u0131\u015f\u0131nda, \u00fcst derece mahkemelerinde avukatla temsil bir tercih de\u011fil, zorunluluktur.<\/em><\/h5>\n<p>Avukatla temsilin zorunlu oldu\u011fu bir yarg\u0131lamada lisansl\u0131 bir avukat olmadan mahkemeye yap\u0131lan ba\u015fvuru veya beyan ge\u00e7ersiz kabul edilir. D\u00fczenlemeler yabanc\u0131 avukatlar a\u00e7\u0131s\u0131ndan da s\u0131k\u0131d\u0131r. Macaristan Barosuna <em>\u00fcgyv\u00e9d<\/em> olarak kabul edilmemi\u015f yabanc\u0131 avukatlar da bu yarg\u0131lamalarda m\u00fcvekkillerini temsil edemez. Bu durum kay\u0131tl\u0131 Avrupa avukatlar\u0131 a\u00e7\u0131s\u0131ndan da ilgili mesleki stat\u00fc ve kabul \u015fartlar\u0131na tabidir.<\/p>\n<p>Bir avukat\u0131n deste\u011fi, yarg\u0131lama s\u00fcrecinin do\u011fru \u015fekilde y\u00fcr\u00fct\u00fclmesine yard\u0131mc\u0131 olur.
