S\u00fcreci Nas\u0131l Y\u00f6netmelisiniz?"},"content":{"rendered":"<p>Miras i\u015flemlerinde bir avukat\u0131n deste\u011finin neden \u00f6nemli olabilece\u011fine bakal\u0131m:<\/p>\n<ul>\n<li><em>\u0130lk olarak,<\/em>Macaristan\u2019da yasal ve vasiyetnameye dayal\u0131 mirasa ili\u015fkin mevzuat karma\u015f\u0131k olabilir. Bir hukuk\u00e7unun deste\u011fi olmadan s\u00fcre\u00e7te ilerlemek zorla\u015fabilir. Konuya a\u015fina olmayan Macar avukatlar dahi miras uyu\u015fmazl\u0131klar\u0131nda g\u00fc\u00e7l\u00fck ya\u015fayabilir. Bunun nedenlerinden biri, 2014 y\u0131l\u0131nda \u00f6nemli de\u011fi\u015fiklikler getiren nispeten yeni Medeni Kanun\u2019un ayr\u0131nt\u0131l\u0131 d\u00fczenlemeleridir. Miras hukuku alan\u0131nda deneyimli bir avukat, hukuki gerekliliklerin yerine getirilmesini ve s\u00fcrecin do\u011fru ve etkin bi\u00e7imde y\u00fcr\u00fct\u00fclmesini sa\u011flayabilir.<\/li>\n<li><em>\u0130kinci olarak,<\/em>bir avukat malvarl\u0131\u011f\u0131n\u0131n adil ve miras b\u0131rakan\u0131n iradesine uygun \u015fekilde payla\u015ft\u0131r\u0131lmas\u0131 konusunda hukuki dan\u0131\u015fmanl\u0131k sa\u011flayabilir. Bu s\u00fcre\u00e7te ilgili t\u00fcm taraflar\u0131n yasal haklar\u0131 da dikkate al\u0131n\u0131r.<\/li>\n<li><em>\u00dc\u00e7\u00fcnc\u00fc olarak,<\/em>gelece\u011fini planlayan ki\u015filer miras\u00e7\u0131lar\u0131 aras\u0131nda do\u011fabilecek uyu\u015fmazl\u0131klar\u0131 \u00f6nlemek amac\u0131yla malvarl\u0131klar\u0131n\u0131n \u00f6l\u00fcmden sonraki ak\u0131betini hen\u00fcz hayattayken d\u00fczenler. Siz de \u00f6l\u00fcm\u00fcn\u00fczden sonra malvarl\u0131\u011f\u0131n\u0131zla ilgili belirsizlikler b\u0131rakmak istemiyorsan\u0131z Macaristan\u2019da bir avukata ba\u015fvurabilirsiniz. Macar avukatlar\u0131, daha do\u011frusu attorney stat\u00fcs\u00fcndeki avukatlar, vasiyetname haz\u0131rlama ve tasdik etme yetkisine sahiptir.<\/li>\n<li><em>D\u00f6rd\u00fcnc\u00fc olarak,<\/em>miras i\u015flemleri noter \u00f6n\u00fcnde y\u00fcr\u00fct\u00fcl\u00fcr. Hukuki temsil zorunlu de\u011fildir. Ancak i\u015flemlerin resm\u00ee dili Macarca oldu\u011fundan bir avukat taraf\u0131ndan temsil edilmek \u00f6nemle tavsiye edilir. Avukat, s\u00fcre\u00e7 s\u0131ras\u0131nda ortaya \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm\u00fcne de yard\u0131mc\u0131 olabilir.
