Bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda Macaristan\u2019daki son y\u0131llar\u0131n yasama uygulamalar\u0131n\u0131 savunmak g\u00fc\u00e7t\u00fcr. S\u00fcre\u00e7ler \u00e7o\u011fu zaman usul a\u00e7\u0131s\u0131ndan aceleye getirilmi\u015f, mesleki ve teknik haz\u0131rl\u0131k yetersiz kalm\u0131\u015f, toplumsal isti\u015fare ise ya son derece s\u0131n\u0131rl\u0131 tutulmu\u015f ya da hi\u00e7 ger\u00e7ekle\u015ftirilmemi\u015ftir.\n  <\/p>\n<p>\n    Hukuk\u00e7ular olarak, d\u00fczenleyici ortam\u0131n kalitesinin bir\u00e7ok durumda savunulamaz bir d\u00fczeye geriledi\u011fini s\u00f6ylemek abart\u0131 de\u011fildir.\n  <\/p>\n<h2>Milletvekili Kanun Teklifleri: \u201cSistematik Bir Dolanma Yolu\u201d<\/h2>\n<p>\n    En ciddi sorunlardan biri, h\u00fck\u00fcmetin yasama faaliyetlerinin \u00f6nemli bir b\u00f6l\u00fcm\u00fcn\u00fcn milletvekili kanun teklifleri yoluyla parlamentoya sunulmas\u0131yd\u0131. Bu y\u00f6ntem \u015feklen hukuka uygun olsa da sistematik bi\u00e7imde kullan\u0131ld\u0131\u011f\u0131nda:\n  <\/p>\n<ul>\n<li>\u00f6n etki de\u011ferlendirmelerinin,<\/li>\n<li>toplumsal isti\u015fare y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn,<\/li>\n<li>mesleki ve teknik incelemenin devre d\u0131\u015f\u0131 b\u0131rak\u0131lmas\u0131na imk\u00e2n tan\u0131yor.<\/li>\n<\/ul>\n<p>\n    Uygulamadaki sonu\u00e7lar\u0131 ise biliniyor: birbiriyle \u00e7eli\u015fen d\u00fczenlemeler, sonradan yap\u0131lan \u201cyang\u0131n s\u00f6nd\u00fcrme\u201d niteli\u011findeki de\u011fi\u015fiklikler ve y\u00fcr\u00fcrl\u00fc\u011fe girdi\u011fi andan itibaren nas\u0131l uygulanaca\u011f\u0131 belirsiz mevzuat.\n  <\/p>\n<p>\n    Bu, verimlilik de\u011fil, kurumsal sorumsuzluktur.\n  <\/p>\n<h2>Hukuki Belirlili\u011fin A\u015f\u0131nmas\u0131<\/h2>\n<p>\n    \u00d6ng\u00f6r\u00fclemeyen yasama faaliyetleri yaln\u0131zca teorik bir hukuk sorunu de\u011fildir. Somut ekonomik ve toplumsal sonu\u00e7lar do\u011furur:\n  <\/p>\n<ul>\n<li>hukuki yorum ve uygulama riski artar,<\/li>\n<li>yat\u0131r\u0131m ortam\u0131 olumsuz etkilenir,<\/li>\n<li>devlete ve kurumlar\u0131na duyulan g\u00fcven azal\u0131r.<\/li>\n<\/ul>\n<p>\n    Hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcne dayal\u0131 bir devlette mevzuat bir s\u00fcrpriz de\u011fil, \u00f6ng\u00f6r\u00fclebilir bir referans noktas\u0131d\u0131r. D\u00fczenlemeler s\u00fcrekli olarak y\u00fcr\u00fcrl\u00fc\u011fe girdikten sonra d\u00fczeltilmek zorunda kal\u0131yorsa bu i\u015flev ortadan kalkar.\n  <\/p>\n<h2>H\u00fck\u00fcmet De\u011fi\u015fimi: Mucizevi Bir \u00c7\u00f6z\u00fcm De\u011fil, Ger\u00e7ek Bir F\u0131rsat<\/h2>\n<p>\n    H\u00fck\u00fcmet de\u011fi\u015fikli\u011fi tek ba\u015f\u0131na daha kaliteli bir yasama s\u00fcrecini garanti etmez. Ancak asgari usuli standartlar\u0131n yeniden tesis edilmesi i\u00e7in ger\u00e7ek bir f\u0131rsat sunar. Bu ideolojik de\u011fil, mesleki bir meseledir.\n  <\/p>\n<p>\n    De\u011fi\u015fimin ger\u00e7ek \u00f6l\u00e7\u00fct\u00fc neyin d\u00fczenlendi\u011fi de\u011fil, nas\u0131l d\u00fczenlendi\u011fi olacakt\u0131r:\n  <\/p>\n<ul>\n<li>anlaml\u0131 toplumsal isti\u015fare s\u00fcre\u00e7lerinin yeniden uygulan\u0131p uygulanmad\u0131\u011f\u0131,<\/li>\n<li>milletvekili kanun teklifleri \u00fczerinden kullan\u0131lan \u201cdolamba\u00e7l\u0131 yolun\u201d sona erip ermedi\u011fi,<\/li>\n<li>ger\u00e7ek etki de\u011ferlendirmelerinin ve mesleki isti\u015farenin yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131.<\/li>\n<\/ul>\n<p>\n    Kaliteli yasama karar alma s\u00fcre\u00e7lerini yava\u015flatmaz; hatalar\u0131 \u00f6nler.\n  <\/p>\n<h2>Hukuk\u00e7ular\u0131n Beklentisi: Usuli Adalet<\/h2>\n<p>\n    Hukuk\u00e7ular olarak beklentimiz siyasi i\u00e7erik de\u011fil, usuli adalettir:\n  <\/p>\n<ul>\n<li>\u015feffaf haz\u0131rl\u0131k s\u00fcre\u00e7leri,<\/li>\n<li>\u00f6ng\u00f6r\u00fclebilir s\u00fcreler,<\/li>\n<li>mesleki ele\u015ftiriyi bir engel de\u011fil, kaynak olarak g\u00f6ren bir yakla\u015f\u0131m.<\/li>\n<\/ul>\n<p>\n    Yasama bir g\u00fc\u00e7 g\u00f6sterisi de\u011fil, kamusal g\u00fcven sorumlulu\u011fudur.\n  <\/p>\n<h2>Macaristan\u2019a \u0130\u00e7eriden ve Uluslararas\u0131 Bir Perspektiften Bak\u0131\u015f<\/h2>\n<p>\n    Macaristan k\u00f6kenli ve toplam be\u015f \u00fclkede yetkilendirilmi\u015f ve aktif olarak \u00e7al\u0131\u015fan hukuk\u00e7ular olarak, Macaristan\u2019daki mevzuat\u0131n geli\u015fimini d\u0131\u015far\u0131dan g\u00f6zlemlemiyoruz. Uluslararas\u0131 \u00e7al\u0131\u015fmalar\u0131m\u0131zda, bir \u00fclkenin hukuk sisteminin kalitesinin ekonomik kararlar\u0131, hukuki belirlili\u011fi ve \u00fclkenin uluslararas\u0131 konumunu nas\u0131l etkiledi\u011fini her g\u00fcn g\u00f6r\u00fcyoruz.\n  <\/p>\n<p>\n    Tam da bu nedenle, yasama s\u00fcrecinin ger\u00e7ek bir kat\u0131l\u0131m imk\u00e2n\u0131 sunmas\u0131 h\u00e2linde anlaml\u0131 toplumsal isti\u015fare s\u00fcre\u00e7lerine mesleki sorumluluk bilinciyle katk\u0131da bulunmaya haz\u0131r\u0131z. Deneyimimiz ve uluslararas\u0131 kar\u015f\u0131la\u015ft\u0131rmal\u0131 perspektifimiz, d\u00fczenlemelerin yaln\u0131zca siyasi a\u00e7\u0131dan etkili de\u011fil, mesleki a\u00e7\u0131dan savunulabilir ve s\u00fcrd\u00fcr\u00fclebilir olmas\u0131na katk\u0131 sa\u011flayabilir.\n  <\/p>\n<p>\n    Ayn\u0131 zamanda hukuk\u00e7ular olarak yasama s\u00fcrecini ve mevzuat\u0131n kalitesini takip etmeyi, gerekti\u011finde mesleki ele\u015ftirilerimizi dile getirmeyi g\u00f6revimizin bir par\u00e7as\u0131 olarak g\u00f6r\u00fcyoruz. Bunu muhalif bir tutumla de\u011fil, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcn\u00fcn asgari gereklerine ba\u011fl\u0131l\u0131\u011f\u0131m\u0131z nedeniyle yap\u0131yoruz.\n  <\/p>\n<p>\n    Toplumsal isti\u015fare bir jest de\u011fil, kurumsal bir yap\u0131d\u0131r.
