BAE\u2019de Neler Uygulanabilir, Neler Uygulanamaz?<\/strong><\/p>\n<p>Macaristan k\u00f6kenli, Almanya\u2019da kurulmu\u015f, farkl\u0131 hukuk sistemlerinde faaliyet g\u00f6steren ve Birle\u015fik Arap Emirlikleri\u2019nde lisansl\u0131 hukuki dan\u0131\u015fmanl\u0131k hizmeti sunan uluslararas\u0131 bir hukuk b\u00fcrosu olarak hesap verebilirlik konusunu siyasi bir s\u00f6ylem olarak de\u011fil, hukuken uygulanabilirlik ve tenfiz a\u00e7\u0131s\u0131ndan ele al\u0131yoruz.<\/p>\n<p>Kamuoyundaki tart\u0131\u015fmalarda kesinle\u015fmi\u015f bir yarg\u0131 karar\u0131n\u0131n varl\u0131\u011f\u0131 ile bu karar\u0131n yurt d\u0131\u015f\u0131nda icra edilebilir olmas\u0131 s\u0131kl\u0131kla birbirine kar\u0131\u015ft\u0131r\u0131l\u0131yor. Birle\u015fik Arap Emirlikleri \u2014 Dubai d\u00e2hil \u2014 a\u00e7\u0131s\u0131ndan bu ayr\u0131m \u00f6zellikle \u00f6nemli. AB \u00fcyesi olmayan BAE, Macaristan veya di\u011fer Avrupa \u00fclkelerinin mahkeme kararlar\u0131n\u0131 ve idari kararlar\u0131n\u0131 otomatik olarak uygulam\u0131yor. Yabanc\u0131 bir karar\u0131n tenfizi, \u015fekli olmaktan uzak ve s\u0131k\u0131 \u015fartlara tabi ayr\u0131 bir tan\u0131ma ve tenfiz s\u00fcrecini gerektiriyor.<\/p>\n<p>Kamuoyunda s\u0131kl\u0131kla \u201ctam hesap verebilirlik\u201d talepleri dile getiriliyor. Hukuki a\u00e7\u0131dan ise hesap verebilirlik siyasi bir slogan de\u011fil; yarg\u0131 yetkisi, tenfiz ve uluslararas\u0131 hukuk meselesidir. Bu nedenle rahats\u0131z edici olsa da gerekli bir sorunun sorulmas\u0131 gerekiyor: Macar devletinin yetkisi ger\u00e7ekte ne kadar uza\u011fa uzan\u0131yor? Hukuki ger\u00e7ekli\u011fin s\u0131n\u0131rlar\u0131 nerede ba\u015fl\u0131yor \u2014 \u00f6rne\u011fin Dubai\u2019de?<\/p>\n<p><strong>Yarg\u0131 Yetkisi ve Tenfiz Aras\u0131ndaki Fark<\/strong><\/p>\n<p>Bir devletin;<\/p>\n<ul>\n<li>hukuka ayk\u0131r\u0131l\u0131\u011f\u0131 tespit etmesi,<\/li>\n<li>kesin ve ba\u011flay\u0131c\u0131 bir karar vermesi,<\/li>\n<li>bu karar\u0131 ba\u015fka bir \u00fclkede fiilen icra ettirebilmesi aras\u0131nda temel bir fark bulunuyor.<\/li>\n<\/ul>\n<p>Birle\u015fik Arap Emirlikleri Avrupa Birli\u011fi \u00fcyesi de\u011fil ve AB\u2019nin s\u0131n\u0131r \u00f6tesi kararlar\u0131n tan\u0131nmas\u0131 ve tenfizine ili\u015fkin mekanizmalar\u0131n\u0131n par\u00e7as\u0131 de\u011fil. Bu nedenle Avrupa \u00fclkelerindeki \u2014 Macaristan d\u00e2hil \u2014 makamlar\u0131n veya mahkemelerin kararlar\u0131 BAE\u2019de kendili\u011finden icra edilebilir h\u00e2le gelmiyor.<\/p>\n<p><strong>BAE Bir \u201cG\u00fcvenli Liman\u201d m\u0131? Daha Ayr\u0131nt\u0131l\u0131 Bir Hukuki De\u011ferlendirme<\/strong><\/p>\n<p>BAE ve \u00f6zellikle Dubai, son y\u0131llarda bilin\u00e7li bi\u00e7imde uluslararas\u0131 bir finans ve i\u015f merkezi olarak konumland\u0131. Bu yap\u0131n\u0131n unsurlar\u0131ndan biri, kendine \u00f6zg\u00fc bir hukuki ortam sunmas\u0131d\u0131r. Bu sistem:<\/p>\n<ul>\n<li>yerel hukuk kapsam\u0131nda hukuka uygun \u015fekilde kay\u0131tl\u0131 varl\u0131klara g\u00fc\u00e7l\u00fc koruma sa\u011flar,<\/li>\n<li>ancak yabanc\u0131 mahkeme kararlar\u0131n\u0131n tan\u0131nmas\u0131n\u0131 tamamen d\u0131\u015flamaz.<\/li>\n<\/ul>\n<p>Buradaki temel kavram tan\u0131mad\u0131r. Yabanc\u0131 bir mahkeme karar\u0131 BAE\u2019de otomatik olarak icra edilemez. Karar\u0131n tan\u0131nmas\u0131 i\u00e7in ayr\u0131 bir hukuki s\u00fcre\u00e7 y\u00fcr\u00fct\u00fclmesi gerekir. Bu s\u00fcre\u00e7te BAE mahkemesi, di\u011fer hususlar\u0131n yan\u0131 s\u0131ra:<\/p>\n<ul>\n<li>karar\u0131n BAE kamu d\u00fczenine ayk\u0131r\u0131 olup olmad\u0131\u011f\u0131n\u0131,<\/li>\n<li>gerekli usuli g\u00fcvencelere uyulup uyulmad\u0131\u011f\u0131n\u0131,<\/li>\n<li>ikili veya \u00e7ok tarafl\u0131 bir hukuki i\u015f birli\u011fi dayana\u011f\u0131n\u0131n bulunup bulunmad\u0131\u011f\u0131n\u0131 inceler.<\/li>\n<\/ul>\n<p>Bunlar yaln\u0131zca \u015fekli \u015fartlar de\u011fil, ger\u00e7ek hukuki denetim \u00f6l\u00e7\u00fctleridir.<\/p>\n<p><strong>Bu Durum Macaristan\u2019daki Hesap Verebilirlik S\u00fcre\u00e7leri A\u00e7\u0131s\u0131ndan Ne Anlama Geliyor?<\/strong><\/p>\n<p>Hukuki ger\u00e7eklik \u015fu \u015fekilde \u00f6zetlenebilir:<\/p>\n<ul>\n<li>Macaristan\u2019da kesinle\u015fmi\u015f bir karar\u0131n Dubai\u2019de mutlaka icra edilebilece\u011fi s\u00f6ylenemez;<\/li>\n<li>Offshore, holding veya trust yap\u0131lar\u0131n\u0131n s\u00f6z konusu oldu\u011fu durumlarda malvarl\u0131\u011f\u0131na ula\u015fmak \u00f6zellikle karma\u015f\u0131kt\u0131r;<\/li>\n<li>Cezai sorumluluk ile \u00f6zel hukuk yoluyla malvarl\u0131\u011f\u0131n\u0131n geri al\u0131nmas\u0131 birbirinden \u00f6nemli \u00f6l\u00e7\u00fcde farkl\u0131 s\u00fcre\u00e7lere tabidir.<\/li>\n<\/ul>\n<p>Bu, \u201chi\u00e7bir \u015fey yap\u0131lamaz\u201d anlam\u0131na gelmiyor.
