Bir d\u00f6nemin sona ermekte oldu\u011funa ve kurumsal a\u00e7\u0131dan daha d\u00fczenli bir y\u00f6netim anlay\u0131\u015f\u0131 i\u00e7in ger\u00e7ek bir f\u0131rsat do\u011fabilece\u011fine i\u015faret ediyor.\n  <\/p>\n<h3 style=\"text-align: left; margin-top: 32px; margin-bottom: 16px;\">\n    Son Y\u0131llar\u0131n G\u00f6r\u00fcn\u00fcm\u00fc: Bir Risk Unsuru Olarak Yasama S\u00fcreci<br \/>\n  <\/h3>\n<p>\n    Yabanc\u0131 g\u00f6zlemciler a\u00e7\u0131s\u0131ndan son y\u0131llarda Macaristan\u2019daki yasama faaliyetlerine ili\u015fkin temel sorun, d\u00fczenlemelerin i\u00e7eri\u011finden \u00e7ok haz\u0131rlanma ve kabul edilme s\u00fcre\u00e7lerinde ortaya \u00e7\u0131kt\u0131. \u00d6zellikle a\u015fa\u011f\u0131daki uygulamalar \u00fclkenin hukuki \u00f6ng\u00f6r\u00fclebilirli\u011fine ili\u015fkin alg\u0131s\u0131n\u0131 \u00f6nemli \u00f6l\u00e7\u00fcde zay\u0131flatt\u0131:\n  <\/p>\n<ul style=\"margin-top: 12px; margin-bottom: 24px; padding-left: 24px;\">\n<li>\u00e7o\u011fu zaman etki de\u011ferlendirmesi yap\u0131lmadan ger\u00e7ekle\u015ftirilen ad hoc mevzuat de\u011fi\u015fiklikleri,<\/li>\n<li>haz\u0131rl\u0131k ve isti\u015fare y\u00fck\u00fcml\u00fcl\u00fcklerini a\u015fmak amac\u0131yla milletvekili kanun tekliflerinin yayg\u0131n bi\u00e7imde kullan\u0131lmas\u0131,<\/li>\n<li>k\u0131sa s\u00fcreli ve \u00e7o\u011fu zaman \u015fekli nitelikte kalan kamuoyu isti\u015fareleri,<\/li>\n<li>uygulamadaki sonu\u00e7lar\u0131 daha sonra acil m\u00fcdahalelerle d\u00fczeltilmek zorunda kalan ani d\u00fczenleme de\u011fi\u015fiklikleri.<\/li>\n<\/ul>\n<p>\n    Yabanc\u0131 yat\u0131r\u0131mc\u0131 a\u00e7\u0131s\u0131ndan bunlar teorik meseleler de\u011fil. Uluslararas\u0131 akt\u00f6rler \u00f6ncelikle;\n  <\/p>\n<ul style=\"margin-top: 12px; margin-bottom: 24px; padding-left: 24px;\">\n<li>yasama s\u00fcrecinde usuli disiplinin yeniden tesis edilip edilmedi\u011fine,<\/li>\n<li>milletvekili kanun tekliflerinin sistematik kullan\u0131m\u0131n\u0131n azal\u0131p azalmad\u0131\u011f\u0131na,<\/li>\n<li>anlaml\u0131 etki de\u011ferlendirmeleri ve mesleki isti\u015fare s\u00fcre\u00e7lerinin uygulan\u0131p uygulanmad\u0131\u011f\u0131na,<\/li>\n<li>mevzuat kalitesinin yaln\u0131zca s\u00f6ylem d\u00fczeyinde de\u011fil, \u00f6l\u00e7\u00fclebilir bi\u00e7imde iyile\u015fip iyile\u015fmedi\u011fine bak\u0131yor.<\/li>\n<\/ul>\n<p>\n    Bu alanlarda somut bir de\u011fi\u015fim g\u00f6r\u00fclmesi, herhangi bir yat\u0131r\u0131m te\u015fvik kampanyas\u0131ndan \u00e7ok daha fazla \u00f6nem ta\u015f\u0131yacakt\u0131r.\n  <\/p>\n<h3 style=\"text-align: left; margin-top: 32px; margin-bottom: 16px;\">\n    Neden D\u0131\u015far\u0131dan Bak\u0131ld\u0131\u011f\u0131nda Farkl\u0131 G\u00f6r\u00fcn\u00fcyor?<br \/>\n  <\/h3>\n<p>\n    Macaristan\u2019da yasama faaliyetleri \u00e7o\u011fu zaman siyasi tart\u0131\u015fmalar \u00e7er\u00e7evesinde de\u011ferlendiriliyor. Yurt d\u0131\u015f\u0131ndan bak\u0131ld\u0131\u011f\u0131nda ise konu daha teknokratik bir perspektifle ele al\u0131n\u0131yor: s\u00fcre\u00e7ler, riskler ve kar\u015f\u0131la\u015ft\u0131r\u0131labilir uygulamalar \u00fczerinden.\n  <\/p>\n<p>\n    Uluslararas\u0131 d\u00fczlemde de faaliyet g\u00f6steren bir hukuk sisteminde mevzuat\u0131n kalitesi bir anlamda ihra\u00e7 edilen bir g\u00fcven unsuru; bunun eksikli\u011fi ise yabanc\u0131 yat\u0131r\u0131m a\u00e7\u0131s\u0131ndan cayd\u0131r\u0131c\u0131 bir fakt\u00f6r h\u00e2line geliyor.\n  <\/p>\n<h3 style=\"text-align: left; margin-top: 32px; margin-bottom: 16px;\">\n    Bir Hukuk B\u00fcrosunun Perspektifi<br \/>\n  <\/h3>\n<p>\n    Macaristan k\u00f6kenli, Almanya\u2019dan faaliyetlerine ba\u015flayan ve Birle\u015fik Arap Emirlikleri d\u00e2hil \u00e7e\u015fitli yarg\u0131 b\u00f6lgelerinde yetkilendirilmi\u015f bir hukuk b\u00fcrosu olarak, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fcndeki eksikliklerin hangi noktada ticari bir risk unsuruna d\u00f6n\u00fc\u015ft\u00fc\u011f\u00fcn\u00fc a\u00e7\u0131k bi\u00e7imde g\u00f6r\u00fcyoruz. Bu nedenle bizim a\u00e7\u0131m\u0131zdan belirleyici olan de\u011fi\u015fime ili\u015fkin s\u00f6ylem de\u011fil, de\u011fi\u015fimin kurumsal ve usuli a\u00e7\u0131dan inand\u0131r\u0131c\u0131l\u0131\u011f\u0131d\u0131r.\n  <\/p>\n<p>\n    D\u0131\u015f d\u00fcnya \u015fu anda Macaristan\u2019\u0131 izliyor.
