BAE son y\u0131llarda yabanc\u0131 mahkeme kararlar\u0131n\u0131n tenfizine daha elveri\u015fli bir yarg\u0131 alan\u0131 h\u00e2line gelmi\u015f olsa da tenfiz konusunda s\u0131k\u0131 ve se\u00e7ici bir yakla\u015f\u0131m s\u00fcrd\u00fcr\u00fcl\u00fcyor.\n  <\/p>\n<p>\n    BAE mahkemelerinin tenfiz etmeyece\u011fi veya yaln\u0131zca belirli b\u00f6l\u00fcmlerini tenfiz edece\u011fi \u00e7ok say\u0131da kesinle\u015fmi\u015f yabanc\u0131 mahkeme karar\u0131 bulunuyor.\n  <\/p>\n<h2>Kesinle\u015fmi\u015f Olsa Bile BAE\u2019de Hangi Kararlar Tenfiz Edilemez?<\/h2>\n<h3>1. Kamu D\u00fczenine veya Ahlaka Ayk\u0131r\u0131 Kararlar<\/h3>\n<p>\n    BAE\u2019nin kamu d\u00fczenine veya ahlak anlay\u0131\u015f\u0131na ayk\u0131r\u0131 kararlar tenfiz edilmez. Bu kapsamda \u00f6zellikle a\u015fa\u011f\u0131daki konulara ili\u015fkin kararlar s\u00f6z konusu olabilir:\n  <\/p>\n<ul>\n<li>kumar,<\/li>\n<li>pornografi,<\/li>\n<li>evlilik d\u0131\u015f\u0131 birlikte ya\u015fama veya cinsel ili\u015fkilere ili\u015fkin hususlar,<\/li>\n<li>\u0130slam hukukunun temel ilkelerine a\u00e7\u0131k\u00e7a ayk\u0131r\u0131 y\u00fck\u00fcml\u00fcl\u00fckler.<\/li>\n<\/ul>\n<p>\n    Bu durum tenfiz a\u00e7\u0131s\u0131ndan kesin bir engel olu\u015fturur.\n  <\/p>\n<h3>2. Faiz \u0130\u00e7eren Kararlar<\/h3>\n<p>\n    BAE hukukunda faiz mutlak olarak yasaklanm\u0131\u015f de\u011fildir. Bununla birlikte;\n  <\/p>\n<ul>\n<li>fahi\u015f,<\/li>\n<li>cezai nitelikte,<\/li>\n<li>veya \u015eeriat ilkeleriyle ba\u011fda\u015fmayan faiz hesaplamalar\u0131n\u0131n tenfizi m\u00fcmk\u00fcn de\u011fildir.<\/li>\n<\/ul>\n<p>\n    Uygulamada, yabanc\u0131 mahkeme karar\u0131ndaki as\u0131l alaca\u011f\u0131n tenfizine izin verilirken faiz k\u0131sm\u0131n\u0131n tenfiz d\u0131\u015f\u0131nda b\u0131rak\u0131lmas\u0131 s\u00f6z konusu olabilir.\n  <\/p>\n<h3>3. Cezaland\u0131r\u0131c\u0131 Tazminat<\/h3>\n<p>\n    BAE hukukunda punitive damages olarak bilinen cezaland\u0131r\u0131c\u0131 tazminat kurumu bulunmuyor. Bu nedenle;\n  <\/p>\n<ul>\n<li>Common Law yarg\u0131 sistemlerinde cayd\u0131rma veya cezaland\u0131rma amac\u0131yla h\u00fckmedilen tazminatlar\u0131n tenfizi m\u00fcmk\u00fcn de\u011fildir. Yaln\u0131zca kan\u0131tlanm\u0131\u015f fiil\u00ee zarar dikkate al\u0131nabilir.<\/li>\n<\/ul>\n<h3>4. Aile Hukuku Kararlar\u0131n\u0131n Belirli Unsurlar\u0131<\/h3>\n<p>\n    A\u015fa\u011f\u0131daki konulara ili\u015fkin yabanc\u0131 mahkeme kararlar\u0131n\u0131n tan\u0131nmas\u0131 veya tenfizi genellikle m\u00fcmk\u00fcn de\u011fildir:\n  <\/p>\n<ul>\n<li>e\u015fcinsel evliliklerin tan\u0131nmas\u0131,<\/li>\n<li>\u0130slam hukuku ilkeleriyle ba\u011fda\u015fmayan \u00e7ocuk velayeti veya din\u00ee yeti\u015ftirmeye ili\u015fkin h\u00fck\u00fcmler,<\/li>\n<li>ki\u015fisel stat\u00fcye ili\u015fkin belirli yabanc\u0131 mahkeme kararlar\u0131.<\/li>\n<\/ul>\n<p>\n    Bu durumlarda BAE mahkemesi kendi hukuki de\u011ferlendirmesini yapar.\n  <\/p>\n<h3>5. BAE Mahkemelerinin M\u00fcnhas\u0131r Yetkisine Giren Uyu\u015fmazl\u0131klar<\/h3>\n<p>\n    Uyu\u015fmazl\u0131\u011f\u0131n;\n  <\/p>\n<ul>\n<li>BAE\u2019de bulunan ta\u015f\u0131nmazlara,<\/li>\n<li>yerel i\u015f ili\u015fkilerine,<\/li>\n<li>yerel ticari acentelik ili\u015fkilerine.<\/li>\n<\/ul>\n<p>\n    ili\u015fkin olmas\u0131 h\u00e2linde yabanc\u0131 mahkeme karar\u0131n\u0131n tenfizi m\u00fcmk\u00fcn de\u011fildir. Bu konularda BAE mahkemeleri m\u00fcnhas\u0131r yetkiye sahiptir.\n  <\/p>\n<h3>6. Usuli Eksiklik \u0130\u00e7eren veya Kesinle\u015fmemi\u015f Kararlar<\/h3>\n<p>\n    A\u015fa\u011f\u0131daki kararlar tenfiz edilemez:\n  <\/p>\n<ul>\n<li>kesin ve ba\u011flay\u0131c\u0131 h\u00e2le gelmemi\u015f kararlar,<\/li>\n<li>usul\u00fcne uygun tebligat yap\u0131lmadan verilen kararlar,<\/li>\n<li>adil yarg\u0131lanma ve usuli g\u00fcvencelere ayk\u0131r\u0131 kararlar.<\/li>\n<\/ul>\n<h2>Bu Konu Neden Yabanc\u0131 Mahkeme Karar\u0131 Verilmeden \u00d6nce \u00d6nem Ta\u015f\u0131yor?<\/h2>\n<p>\n    En s\u0131k kar\u015f\u0131la\u015f\u0131lan ve en y\u00fcksek maliyete yol a\u00e7an hatalardan biri, hukuki dan\u0131\u015fmanl\u0131\u011f\u0131n ancak yabanc\u0131 mahkeme karar\u0131 kesinle\u015ftikten sonra al\u0131nmas\u0131d\u0131r. Bu a\u015famada stratejik hareket alan\u0131 b\u00fcy\u00fck \u00f6l\u00e7\u00fcde daralm\u0131\u015f olur.\n  <\/p>\n<p>\n    Ancak bu noktada;\n  <\/p>\n<ul>\n<li>h\u00fckmedilen tutar\u0131n bir b\u00f6l\u00fcm\u00fcn\u00fcn ba\u015f\u0131ndan itibaren BAE\u2019de tenfiz edilemeyece\u011fi,<\/li>\n<li>talebin belirli unsurlar\u0131n\u0131n kamu d\u00fczeni gerek\u00e7esiyle tamamen veya k\u0131smen tenfiz engeliyle kar\u015f\u0131la\u015faca\u011f\u0131,<\/li>\n<li>se\u00e7ilen mahkemenin uyu\u015fmazl\u0131\u011f\u0131 yanl\u0131\u015f bir tenfiz s\u00fcrecine y\u00f6nlendirdi\u011fi ortaya \u00e7\u0131kabilir.<\/li>\n<\/ul>\n<p>\n    Bu a\u015famadan sonra hukuki strateji geli\u015ftirmek yerine, ortaya \u00e7\u0131kan sonu\u00e7lar\u0131n etkisini s\u0131n\u0131rlamak s\u00f6z konusu olur.\n  <\/p>\n<h2>Erken A\u015famada Hukuki Dan\u0131\u015fmanl\u0131k Ne Sa\u011flar?<\/h2>\n<p>\n    Dava veya tahkim s\u00fcreci ba\u015flamadan \u00f6nce yap\u0131lacak do\u011fru bir hukuki de\u011ferlendirme sayesinde:\n  <\/p>\n<ul>\n<li>talep BAE\u2019de tenfize uygun \u015fekilde yap\u0131land\u0131r\u0131l\u0131r,<\/li>\n<li>faiz ve cezaland\u0131r\u0131c\u0131 tazminat gibi sorun yaratabilecek unsurlar \u00f6nceden de\u011ferlendirilir ve gerekti\u011finde ayr\u0131\u015ft\u0131r\u0131l\u0131r,<\/li>\n<li>BAE ana kara mahkemeleri, DIFC veya ADGM aras\u0131ndan uygun yarg\u0131 yolu stratejik olarak belirlenir,<\/li>\n<li>h\u00fckmedilecek tutar\u0131n ne \u00f6l\u00e7\u00fcde fiilen tahsil edilebilece\u011fi ger\u00e7ek\u00e7i bi\u00e7imde de\u011ferlendirilir.<\/li>\n<\/ul>\n<p>\n    Bu a\u015famada, \u201ck\u00e2\u011f\u0131t \u00fczerinde kazan\u0131lm\u0131\u015f\u201d bir karar\u0131n ger\u00e7ek bir mali sonuca d\u00f6n\u00fc\u015fmesi i\u00e7in gerekli hukuki strateji olu\u015fturulur.
