Tasar\u0131, h\u00fck\u00fcmetin ge\u00e7 \u00f6demeler konusunda bir neslin en kapsaml\u0131 yasal m\u00fcdahalesi olarak nitelendirdi\u011fi \u00f6nemli bir ad\u0131m niteli\u011finde. \u0130lk olarak Mart ay\u0131nda duyurulan ve Kral\u2019\u0131n Konu\u015fmas\u0131\u2019nda teyit edilen d\u00fczenleme, son yirmi be\u015f y\u0131l\u0131 a\u015fk\u0131n s\u00fcrenin ge\u00e7 \u00f6demelere y\u00f6nelik en s\u0131k\u0131 tedbirlerini i\u00e7eriyor. B\u00fcy\u00fck \u015firketlere, k\u00fc\u00e7\u00fck tedarik\u00e7ilerine zaman\u0131nda \u00f6deme yapma konusunda a\u00e7\u0131k ve hukuken uygulanabilir y\u00fck\u00fcml\u00fcl\u00fckler getiriyor.\n  <\/p>\n<p>\n    Tasar\u0131yla \u00e7\u00f6z\u00fclmesi hedeflenen sorunun boyutu olduk\u00e7a b\u00fcy\u00fck. Ge\u00e7 \u00f6demeler nedeniyle her g\u00fcn yakla\u015f\u0131k 38 i\u015fletmenin kapand\u0131\u011f\u0131 tahmin ediliyor. Bu rakam ayda binden fazla i\u015fletmeye kar\u015f\u0131l\u0131k geliyor. \u0130\u015fletme sahipleri faaliyetlerini geli\u015ftirmek yerine \u00f6denmemi\u015f faturalar\u0131 tahsil etmek i\u00e7in saatler harcamak zorunda kal\u0131yor. Bu durum i\u015fletmelerin devaml\u0131l\u0131\u011f\u0131n\u0131 ve i\u015fletme sahiplerinin ge\u00e7im kaynaklar\u0131n\u0131 do\u011frudan etkiliyor.\n  <\/p>\n<h2>Tasar\u0131 Neler Getiriyor?<\/h2>\n<p>\n    Tasar\u0131 d\u00f6rt temel reform \u00f6ng\u00f6r\u00fcyor. \u0130lk olarak, b\u00fcy\u00fck \u015firketlerin k\u00fc\u00e7\u00fck tedarik\u00e7ilere yapaca\u011f\u0131 \u00f6demeler i\u00e7in azami 60 g\u00fcnl\u00fck \u00f6deme s\u00fcresi getiriliyor. \u0130kinci olarak, ge\u00e7 \u00f6demelerde faiz uygulanmas\u0131 zorunlu h\u00e2le geliyor. \u00dc\u00e7\u00fcnc\u00fc olarak, K\u00fc\u00e7\u00fck \u0130\u015fletmeler Komiseri\u2019ne (Small Business Commissioner) yeni yapt\u0131r\u0131m yetkileri veriliyor. Bunlar aras\u0131nda k\u00f6t\u00fc \u00f6deme uygulamalar\u0131n\u0131 soru\u015fturma, uyu\u015fmazl\u0131klar\u0131 karara ba\u011flama ve y\u00fck\u00fcml\u00fcl\u00fcklerini s\u00fcrekli ihlal eden i\u015fletmelere para cezas\u0131 uygulama yetkileri bulunuyor. D\u00f6rd\u00fcnc\u00fc olarak, in\u015faat s\u00f6zle\u015fmelerinde hakedi\u015f bedellerinden kesinti yap\u0131larak tutar al\u0131konulmas\u0131 (retention payments) uygulamas\u0131n\u0131n yasaklanmas\u0131 \u00f6ng\u00f6r\u00fcl\u00fcyor.\n  <\/p>\n<p>\n    \u015eeffafl\u0131k ve hesap verebilirlik a\u00e7\u0131s\u0131ndan da yeni y\u00fck\u00fcml\u00fcl\u00fckler getiriliyor. \u00d6demelerini s\u00fcrekli geciktiren b\u00fcy\u00fck \u015firketlerin y\u00f6netim kurullar\u0131 veya denetim komiteleri, \u015firketin yetersiz \u00f6deme performans\u0131 ve bunu d\u00fczeltmek amac\u0131yla al\u0131nan \u00f6nlemler hakk\u0131nda kamuoyuna a\u00e7\u0131klama yapmakla y\u00fck\u00fcml\u00fc olacak.\n  <\/p>\n<h2>Bundan Sonraki S\u00fcre\u00e7<\/h2>\n<p>\n    Tasar\u0131, kanunla\u015fmadan \u00f6nce parlamentodaki yasama s\u00fcrecinin \u00e7e\u015fitli a\u015famalar\u0131ndan ge\u00e7ecek. H\u00fck\u00fcmet, k\u00fc\u00e7\u00fck tedarik\u00e7ilere daha g\u00fc\u00e7l\u00fc koruma sa\u011flarken isti\u015fare s\u00fcrecinde b\u00fcy\u00fck i\u015fletmeler taraf\u0131ndan dile getirilen kayg\u0131lar\u0131 da dikkate almay\u0131 ama\u00e7l\u0131yor. Bu kapsamda azami \u00f6deme s\u00fcrelerine ili\u015fkin s\u0131n\u0131rl\u0131 istisnalar \u00f6ng\u00f6r\u00fcl\u00fcyor. Bu istisnalar\u0131n ayr\u0131nt\u0131lar\u0131 ile Komiser\u2019e verilecek yeni yapt\u0131r\u0131m yetkilerinin kapsam\u0131, tasar\u0131n\u0131n yasama s\u00fcrecinde yak\u0131ndan takip edilmesi gereken ba\u015fl\u0131ca konular aras\u0131nda yer al\u0131yor.\n  <\/p>\n<h2>\u0130\u015fletmeler \u0130\u00e7in \u00d6nemli Hususlar<\/h2>\n<p>\n    Tedarik zincirlerinde faaliyet g\u00f6steren \u015firketlerin mevcut \u00f6deme ko\u015fullar\u0131n\u0131 ve s\u00f6zle\u015fmelerini \u015fimdiden g\u00f6zden ge\u00e7irmesi \u00f6nem ta\u015f\u0131yor. Bu durum hem yeni y\u00fck\u00fcml\u00fcl\u00fcklere tabi olacak b\u00fcy\u00fck \u015firketler hem de d\u00fczenlemenin sa\u011flad\u0131\u011f\u0131 korumadan yararlanacak k\u00fc\u00e7\u00fck tedarik\u00e7iler a\u00e7\u0131s\u0131ndan ge\u00e7erli.
