Ba\u015fvuru, uygulamada s\u0131k kar\u015f\u0131la\u015f\u0131lan bir duruma ili\u015fkin: \u201cY\u00fcksek Protein\u201d gibi izin verilen bir beyan\u0131n belirli gram miktarlar\u0131 gibi ek bilgilerle desteklenmesi.\n  <\/p>\n<p>\n    Bu uyu\u015fmazl\u0131k, s\u00f6z konusu ek bilgilerin izin verilen bir beyan\u0131n a\u00e7\u0131klamas\u0131 olarak kabul edilip edilemeyece\u011fi veya FIC T\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn buna kesin bir s\u0131n\u0131r getirip getirmedi\u011fi sorusunu ilk kez AB d\u00fczeyinde g\u00fcndeme ta\u015f\u0131yor.\n  <\/p>\n<h2>Mevcut Durum: A\u00e7\u0131k Bir Kural, S\u0131n\u0131rl\u0131 Esneklik<\/h2>\n<p>\n    Alman hukuku a\u00e7\u0131s\u0131ndan ba\u015flang\u0131\u00e7 noktas\u0131 olduk\u00e7a a\u00e7\u0131k. FIC T\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 30(3). maddesi i\u00e7tihatta s\u0131n\u0131rlay\u0131c\u0131 bir h\u00fck\u00fcm olarak yorumlan\u0131yor. Buna g\u00f6re zorunlu beslenme bildirimi d\u0131\u015f\u0131nda yaln\u0131zca belirli beslenme bilgilerinin tekrarlanmas\u0131na izin veriliyor. Protein bunlar aras\u0131nda yer alm\u0131yor. Bu nedenle beslenme tablosu d\u0131\u015f\u0131nda protein miktar\u0131n\u0131n ayr\u0131ca ve \u00f6zellikle vurgulanmas\u0131 kural olarak kabul edilmiyor.\n  <\/p>\n<p>\n    Bu yakla\u015f\u0131m Stuttgart Y\u00fcksek B\u00f6lge Mahkemesinin 30 Ocak 2025 tarihli karar\u0131nda da teyit edildi (2 U 145\/23). Mahkeme, \u00f6rne\u011fin bir fincan ba\u015f\u0131na d\u00fc\u015fen protein miktar\u0131n\u0131n ayr\u0131ca vurgulanmas\u0131n\u0131n FIC T\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 30(3). maddesi kapsam\u0131nda olmad\u0131\u011f\u0131na ve g\u0131da etiketleme kurallar\u0131n\u0131 ihlal edebilece\u011fine h\u00fckmetti.\n  <\/p>\n<p>\n    Uygulamada belirleyici olan yaln\u0131zca verilen bilginin do\u011fru olmas\u0131 de\u011fil, nas\u0131l ve hangi ba\u011flamda sunuldu\u011fudur. FIC T\u00fcz\u00fc\u011f\u00fc, beslenme bilgilerinin tutarl\u0131 ve kar\u015f\u0131la\u015ft\u0131r\u0131labilir bir sistem i\u00e7inde verilmesini ama\u00e7l\u0131yor. Belirli besin de\u011ferlerinin se\u00e7ilerek \u00f6ne \u00e7\u0131kar\u0131lmas\u0131 bu sistemle s\u0131n\u0131rl\u0131 \u00f6l\u00e7\u00fcde ba\u011fda\u015f\u0131yor.\n  <\/p>\n<h2>A\u00e7\u0131k Soru: \u0130zin Verilen Bir A\u00e7\u0131klama m\u0131, Yasak Bir Ek Beyan m\u0131?<\/h2>\n<p>\n    BGH\u2019nin ABAD\u2019a ba\u015fvurusu tam olarak bu noktaya odaklan\u0131yor. ABAD\u2019dan, HCR\u2019nin ilgili eklerinde a\u00e7\u0131k\u00e7a \u00f6ng\u00f6r\u00fclmemi\u015f olsa dahi izin verilen bir beyan\u0131n ek bilgilerle ayr\u0131nt\u0131land\u0131r\u0131l\u0131p ayr\u0131nt\u0131land\u0131r\u0131lamayaca\u011f\u0131n\u0131 a\u00e7\u0131kl\u0131\u011fa kavu\u015fturmas\u0131 bekleniyor.\n  <\/p>\n<p>\n    Bu soru uygulama a\u00e7\u0131s\u0131ndan do\u011frudan \u00f6nem ta\u015f\u0131yor. Pek \u00e7ok etiketleme tasar\u0131m\u0131, bir beslenme beyan\u0131n\u0131n a\u00e7\u0131klay\u0131c\u0131 ek bilgilerle birlikte kullan\u0131lmas\u0131na dayan\u0131yor. Ama\u00e7, genel nitelikteki bir beyan\u0131 t\u00fcketici a\u00e7\u0131s\u0131ndan daha somut h\u00e2le getirmek.\n  <\/p>\n<p>\n    Alman hukukunda bug\u00fcne kadar bu t\u00fcr uygulamalar genellikle izin verilmeyen bir geni\u015fletme olarak de\u011ferlendirildi. BGH ise konunun AB hukuku bak\u0131m\u0131ndan a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmas\u0131 gerekti\u011fi sonucuna vararak \u00f6n karar ba\u015fvurusunda bulundu.\n  <\/p>\n<h2>\u0130\u00e7 Pazarda Faaliyet G\u00f6steren \u015eirketler A\u00e7\u0131s\u0131ndan Etkileri<\/h2>\n<p>\n    ABAD\u2019\u0131n verece\u011fi karar\u0131n etkisi Almanya ile s\u0131n\u0131rl\u0131 kalmayacak. Karar, ilgili h\u00fck\u00fcmlerin t\u00fcm \u00dcye Devletlerde uygulanmas\u0131n\u0131 etkileyecek. Avrupa genelindeki g\u0131da etiketleme stratejileri a\u00e7\u0131s\u0131ndan da do\u011frudan \u00f6nem ta\u015f\u0131yacak.\n  <\/p>\n<p>\n    Mevcut durumda \u015firketler a\u00e7\u0131s\u0131ndan uygulama farkl\u0131l\u0131klar\u0131 devam ediyor. Hukuki \u00e7er\u00e7eve AB d\u00fczeyinde uyumla\u015ft\u0131r\u0131lm\u0131\u015f olsa da ulusal uygulamalar hen\u00fcz tamamen yeknesak de\u011fil. Almanya konuyu nispeten kat\u0131 bi\u00e7imde ele al\u0131rken baz\u0131 pazarlarda daha esnek bir uygulama g\u00f6r\u00fcl\u00fcyor.\n  <\/p>\n<p>\n    Bu durum, birden fazla \u00fclkede faaliyet g\u00f6steren \u00fcretici ve distrib\u00fct\u00f6rler a\u00e7\u0131s\u0131ndan \u00f6nemli bir sorun yarat\u0131yor. \u015eirketler bir taraftan \u00fcr\u00fcnlerini Avrupa genelinde ayn\u0131 \u015fekilde sunmak istiyor. Di\u011fer taraftan ayn\u0131 etiketleme farkl\u0131 pazarlarda farkl\u0131 hukuki de\u011ferlendirmelere tabi tutuluyor.\n  <\/p>\n<p>\n    Dolay\u0131s\u0131yla temel mesele yaln\u0131zca belirli bir etiket tasar\u0131m\u0131n\u0131n hukuken savunulup savunulamayaca\u011f\u0131 de\u011fildir. Ayn\u0131 tasar\u0131m\u0131n faaliyet g\u00f6sterilen t\u00fcm pazarlarda hukuken g\u00fcvenli olup olmad\u0131\u011f\u0131 da \u00f6nem ta\u015f\u0131yor. BGH\u2019nin ba\u015fvurusu bu nedenle m\u00fcnferit protein beyanlar\u0131n\u0131n \u00f6tesinde, AB i\u00e7 pazar\u0131nda tutarl\u0131 bir g\u0131da etiketleme uygulamas\u0131n\u0131n sa\u011flanmas\u0131 a\u00e7\u0131s\u0131ndan \u00f6nem ta\u015f\u0131yor.\n  <\/p>\n<h2>Uygulamada Kar\u015f\u0131la\u015f\u0131lan Ba\u015fl\u0131ca Sorunlar<\/h2>\n<p>\n    \u015eirketlerin kar\u015f\u0131la\u015ft\u0131\u011f\u0131 temel sorunlardan biri mevcut ambalajlar\u0131n hukuki a\u00e7\u0131dan de\u011ferlendirilmesidir. Beslenme tablosu d\u0131\u015f\u0131nda ayr\u0131ca vurgulanan protein miktarlar\u0131, do\u011fru bilgi i\u00e7erseler dahi mevcut Alman i\u00e7tihad\u0131 kapsam\u0131nda hukuki risk ta\u015f\u0131yor.\n  <\/p>\n<p>\n    Ayn\u0131 sorun \u201cY\u00fcksek Protein\u201d ifadesinin belirli miktarlarla birlikte kullan\u0131lmas\u0131 a\u00e7\u0131s\u0131ndan da ge\u00e7erli. Bu t\u00fcr bir sunumun hukuka uygunlu\u011fu, ABAD\u2019\u0131n verece\u011fi kararla a\u00e7\u0131kl\u0131\u011fa kavu\u015facak.\n  <\/p>\n<p>\n    Y\u00fczde ifadeleri ve di\u011fer oransal g\u00f6stergeler de uygulamada sorun yarat\u0131yor. \u00d6zellikle hangi de\u011fere at\u0131fta bulunduklar\u0131n\u0131n a\u00e7\u0131k olmad\u0131\u011f\u0131 durumlarda hukuki risk art\u0131yor. Protein beyanlar\u0131nda toplam enerji de\u011ferine oran belirleyici \u00f6nem ta\u015f\u0131yor. Farkl\u0131 hesaplama veya sunum bi\u00e7imleri t\u00fcketiciyi yan\u0131ltma riski do\u011furuyor.\n  <\/p>\n<p>\n    Birden fazla pazarda faaliyet g\u00f6steren \u015firketler a\u00e7\u0131s\u0131ndan di\u011fer \u00f6nemli konu ise ortak bir etiketleme stratejisinin belirlenmesidir. AB hukuku kapsam\u0131nda konu a\u00e7\u0131kl\u0131\u011fa kavu\u015fana kadar ilgili \u00fclkelerdeki uygulamalar\u0131n ayr\u0131 ayr\u0131 de\u011ferlendirilmesi gerekiyor.\n  <\/p>\n<h2>De\u011ferlendirme ve Beklentiler<\/h2>\n<p>\n    BGH\u2019nin \u00f6n karar ba\u015fvurusu, t\u00fcketiciye sunulan izin verilebilir bilgiler ile hukuka ayk\u0131r\u0131 tan\u0131t\u0131m ama\u00e7l\u0131 vurgular aras\u0131ndaki s\u0131n\u0131r\u0131n belirlenmesi a\u00e7\u0131s\u0131ndan \u00f6nemli bir ad\u0131m. Uyu\u015fmazl\u0131k, \u00fcr\u00fcn tasar\u0131m\u0131 ile g\u0131da mevzuat\u0131n\u0131n do\u011frudan kesi\u015fti\u011fi bir alan\u0131 ilgilendiriyor.\n  <\/p>\n<p>\n    K\u0131sa vadede \u015firketlerin mevcut i\u00e7tihad\u0131n \u00e7izdi\u011fi s\u0131n\u0131rlara uygun hareket etmesi gerekiyor. Mevcut yakla\u015f\u0131m ihtiyatl\u0131 bir etiketleme stratejisini gerekli k\u0131l\u0131yor.\n  <\/p>\n<p>\n    Uzun vadede ABAD karar\u0131 bu s\u0131n\u0131rlar\u0131 daha a\u00e7\u0131k h\u00e2le getirecek. Karar mevcut yakla\u015f\u0131m\u0131 teyit edebilir veya daha ayr\u0131nt\u0131l\u0131 bir de\u011ferlendirme standard\u0131 getirebilir. Her iki durumda da i\u00e7 pazardaki hukuki belirlili\u011fin g\u00fc\u00e7lenmesi bekleniyor.\n  <\/p>\n<h2>Avrupa Pazar\u0131 \u0130\u00e7in Hukuki Dan\u0131\u015fmanl\u0131k<\/h2>\n<p>\n    Son geli\u015fmeler, g\u0131da etiketlemesinin art\u0131k yaln\u0131zca ulusal hukuk kapsam\u0131nda de\u011ferlendirilemeyece\u011fini g\u00f6steriyor. Etiketleme stratejilerinin AB hukuku ve farkl\u0131 \u00dcye Devletlerdeki uygulamalar birlikte dikkate al\u0131narak haz\u0131rlanmas\u0131 gerekiyor.\n  <\/p>\n<p>\n    \u00dcreticilere, distrib\u00fct\u00f6rlere ve marka sahiplerine mevcut g\u0131da etiketlerinin hukuki incelemesi ve Avrupa pazar\u0131 i\u00e7in uygun etiketleme stratejilerinin haz\u0131rlanmas\u0131 konusunda dan\u0131\u015fmanl\u0131k sunuyoruz.
