{"id":55390,"date":"2017-08-24T13:06:18","date_gmt":"2017-08-24T11:06:18","guid":{"rendered":"https:\/\/www.nzp.de\/?p=55390"},"modified":"2026-08-06T14:02:25","modified_gmt":"2026-08-06T12:02:25","slug":"the-new-german-design-act","status":"publish","type":"post","link":"https:\/\/www.nzp.de\/tr\/the-new-german-design-act\/","title":{"rendered":"\u201cYeni\u201d Alman Tasar\u0131m Kanunu"},"content":{"rendered":"<p>1 Ocak 2014 tarihinden itibaren, eski Alman Tasar\u0131m Patenti Kanunu y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015f ve yeni Alman Tasar\u0131m Kanunu olarak yeniden adland\u0131r\u0131lm\u0131\u015ft\u0131r. \u00d6nemli bir de\u011fi\u015fiklik, Alman Ticari Marka Kanunu\u2019ndaki (MarkenG, Madde 53) iptal usul\u00fcn\u00fc \u00f6rnek alan yeni bir ge\u00e7ersizlik usul\u00fcn\u00fcn getirilmesidir.<\/p>\n<p>Eski Tasar\u0131m Patenti Kanunu\u2019nda b\u00f6yle bir usul \u00f6ng\u00f6r\u00fclmemi\u015fti. \u00dcreticiler veya t\u00fcccarlar, tescilli bir tasar\u0131ma ancak b\u00f6lge mahkemeleri nezdinde a\u00e7\u0131lan davalar yoluyla itiraz edebiliyordu (Tasar\u0131m Patenti Kanunu\u2019nun 33. maddesinin 2. f\u0131kras\u0131). Bu durum, hem b\u00f6lge mahkemeleri nezdinde hukuki temsilin zorunlu olmas\u0131 hem de davay\u0131 kaybeden taraf\u0131n sadece kendi mahkeme masraflar\u0131n\u0131 de\u011fil, kar\u015f\u0131 taraf\u0131n masraflar\u0131n\u0131 da \u00fcstlenmek zorunda kalmas\u0131 nedeniyle \u00f6nemli bir maliyet riski i\u00e7eriyordu.<br \/>\nAlman Tasar\u0131m Kanunu\u2019nun yeni 34a. maddesinin y\u00fcr\u00fcrl\u00fc\u011fe girmesiyle birlikte, art\u0131k Alman Patent ve Ticari Marka Ofisi\u2019ne gerek\u00e7eli bir yaz\u0131l\u0131 ba\u015fvuru sunmak yeterli hale gelmi\u015ftir. Masraflar makul seviyede kalmakta olup, art\u0131k Patent Masraflar\u0131 Kanunu ve Alman Avukat \u00dccretleri Kanunu uyar\u0131nca belirlenmektedir (Tasar\u0131m Kanunu\u2019nun 34a(6) maddesi).<\/p>\n<p>Yeni Alman Tasar\u0131m Kanunu\u2019ndan \u00e7\u0131kar\u0131labilecek sonu\u00e7lardan biri, tescilli bir tasar\u0131mdan etkilenen taraflar\u0131n art\u0131k nihayet, tescilli bir tasar\u0131m\u0131n iptalini talep etmek i\u00e7in daha basit ve \u00f6nemli \u00f6l\u00e7\u00fcde daha uygun maliyetli bir alternatife sahip olmalar\u0131d\u0131r.<\/p>","protected":false},"excerpt":{"rendered":"<p>With effect from 1 January 2014, the former German Design Patent Act was abolished and renamed as the new German Design Act.
