Mahkemeye ba\u015fvuru, s\u0131k\u0131 kabul edilebilirlik ve usul \u015fartlar\u0131na tabidir. Bu nedenle, kabul edilebilirlik kriterlerinin kar\u015f\u0131lanmamas\u0131 h\u00e2linde ba\u015fvuru esas\u0131 incelenmeden sonu\u00e7land\u0131r\u0131labilir. \u0130lk de\u011ferlendirmemizde, ba\u015fvurunun incelenebilmesi a\u00e7\u0131s\u0131ndan belirleyici olabilecek usule ve Mahkemenin yetkisine ili\u015fkin hususlar\u0131 de\u011ferlendiriyoruz.<\/p>\n<ul>\n<li>Ma\u011fdur s\u0131fat\u0131: Ba\u015fvurucunun ihlalden do\u011frudan etkilendi\u011fini veya S\u00f6zle\u015fme kapsam\u0131nda ba\u015fka bir \u015fekilde ma\u011fdur s\u0131fat\u0131na sahip oldu\u011funu ortaya koyup koyamad\u0131\u011f\u0131.<\/li>\n<li>Yetki: \u015eikayetin Mahkemenin ki\u015fi, yer, zaman ve konu bak\u0131m\u0131ndan yetkisi kapsam\u0131nda bulunup bulunmad\u0131\u011f\u0131.<\/li>\n<li>\u0130\u00e7 hukuk yollar\u0131n\u0131n t\u00fcketilmesi: Mevcut ve etkili i\u00e7 hukuk yollar\u0131n\u0131n t\u00fcketilip t\u00fcketilmedi\u011fi ve S\u00f6zle\u015fme kapsam\u0131ndaki \u015fikayetin \u00f6z\u00fc itibar\u0131yla ulusal makamlar \u00f6n\u00fcnde ileri s\u00fcr\u00fcl\u00fcp s\u00fcr\u00fclmedi\u011fi.<\/li>\n<li>Ba\u015fvuru s\u00fcresi: Ba\u015fvurunun ilgili nihai i\u00e7 hukuk karar\u0131ndan itibaren d\u00f6rt ay i\u00e7inde yap\u0131l\u0131p yap\u0131lamayaca\u011f\u0131.<\/li>\n<li>Temellendirme: Olaylar\u0131n, destekleyici belgelerin ve hukuki gerek\u00e7elerin S\u00f6zle\u015fme kapsam\u0131nda savunulabilir bir \u015fikayet ortaya koyup koymad\u0131\u011f\u0131.<\/li>\n<li>Di\u011fer kabul edilebilirlik ko\u015fullar\u0131: Konunun daha \u00f6nce ba\u015fka bir uluslararas\u0131 merci taraf\u0131ndan incelenip incelenmedi\u011fi, ba\u015fka bir ba\u015fvuruyla esas itibar\u0131yla ayn\u0131 olup olmad\u0131\u011f\u0131, ba\u015fvurunun anonim veya ba\u015fvuru hakk\u0131n\u0131n k\u00f6t\u00fcye kullan\u0131lmas\u0131 niteli\u011finde olup olmad\u0131\u011f\u0131, a\u00e7\u0131k\u00e7a dayanaktan yoksun bulunup bulunmad\u0131\u011f\u0131 ya da ba\u015fka bir kabul edilemezlik nedeninin mevcut olup olmad\u0131\u011f\u0131.<\/li>\n<\/ul>\n<h2>\u0130\u00e7 Hukuk Yollar\u0131n\u0131n T\u00fcketilmesi<\/h2>\n<p style=\"font-weight: 400;\">Avrupa \u0130nsan Haklar\u0131 Mahkemesi, ulusal mahkeme kararlar\u0131na kar\u015f\u0131 ba\u015fvurulabilecek yeni bir kanun yolu veya ek bir temyiz mercii de\u011fildir. Kural olarak ba\u015fvurucular, mevcut ve etkili i\u00e7 hukuk yollar\u0131n\u0131 kullanarak iddia edilen ihlalin \u00f6ncelikle ulusal makamlar taraf\u0131ndan giderilmesine imkan tan\u0131mal\u0131d\u0131r. Bu de\u011ferlendirme her somut olay\u0131n \u00f6zelliklerine g\u00f6re yap\u0131l\u0131r. Do\u011fru usul yolunun belirlenmesi, S\u00f6zle\u015fme kapsam\u0131ndaki \u015fikayetin \u00f6z\u00fc itibar\u0131yla ulusal makamlar \u00f6n\u00fcnde ileri s\u00fcr\u00fcl\u00fcp s\u00fcr\u00fclmedi\u011finin incelenmesi ve A\u0130HM\u2019ye ba\u015fvurulmadan \u00f6nce t\u00fcketilmesi gereken ba\u015fka bir hukuk yolunun bulunup bulunmad\u0131\u011f\u0131n\u0131n de\u011ferlendirilmesi gerekmektedir.<\/p>\n<h2>D\u00f6rt Ayl\u0131k Ba\u015fvuru S\u00fcresi<\/h2>\n<p style=\"font-weight: 400;\">Genel kural olarak bireysel ba\u015fvurunun nihai i\u00e7 hukuk karar\u0131ndan itibaren d\u00f6rt ay i\u00e7inde yap\u0131lmas\u0131 gerekir. D\u00f6rt ayl\u0131k s\u00fcre, 1 \u015eubat 2022 tarihinden itibaren verilen nihai i\u00e7 hukuk kararlar\u0131 bak\u0131m\u0131ndan uygulanmaktad\u0131r. Birden fazla yarg\u0131lama s\u00fcrecinin bulundu\u011fu, karar\u0131n tebli\u011fine veya bildirimine ili\u015fkin sorunlar\u0131n ortaya \u00e7\u0131kt\u0131\u011f\u0131 ya da ola\u011fan\u00fcst\u00fc kanun yollar\u0131na ba\u015fvuruldu\u011fu durumlarda s\u00fcrenin ba\u015flang\u0131\u00e7 tarihinin belirlenmesi karma\u015f\u0131k olabilir.<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"662\"><strong>Ba\u015fvurunun de\u011ferlendirilmesini son g\u00fcnlere b\u0131rakmay\u0131n.<\/strong><\/p>\n<p>Eksiksiz bir ba\u015fvuru; imzal\u0131 ba\u015fvuru formunun yan\u0131 s\u0131ra, di\u011fer hususlar\u0131n yan\u0131nda i\u00e7 hukuk yollar\u0131n\u0131n t\u00fcketildi\u011fini ve ba\u015fvuru s\u00fcresine uyuldu\u011funu g\u00f6steren destekleyici belgeleri de i\u00e7ermelidir. Ba\u015fvurunun erken a\u015famada de\u011ferlendirilmesi, s\u00fcre dolmadan \u00f6nce olaylar\u0131n kronolojisinin, kararlar\u0131n ve delillerin d\u00fczenlenmesine imkan sa\u011flar.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">Usul ge\u00e7mi\u015fini inceliyor, ba\u015fvuru s\u00fcresini ba\u015flatmas\u0131 muhtemel karar\u0131 belirliyor ve ba\u015fvuru i\u00e7in bir yol haritas\u0131 haz\u0131rl\u0131yoruz. Hukuki de\u011ferlendirme, her somut olay\u0131n \u00f6zelliklerine ve ilgili i\u00e7 hukuk usul kurallar\u0131na g\u00f6re yap\u0131lmal\u0131d\u0131r. Ba\u015fvurucular, ek veya ola\u011fan\u00fcst\u00fc bir kanun yolunun d\u00f6rt ayl\u0131k s\u00fcreyi durdurdu\u011funu veya yeniden ba\u015flatt\u0131\u011f\u0131n\u0131 varsaymak yerine zaman\u0131nda hukuki dan\u0131\u015fmanl\u0131k almal\u0131d\u0131r.<\/p>\n<h2>Eksiksiz ve Usule Uygun Bir Ba\u015fvuru<\/h2>\n<p style=\"font-weight: 400;\">Mahkeme \u0130\u00e7t\u00fcz\u00fc\u011f\u00fc\u2019n\u00fcn 47. maddesi uyar\u0131nca bireysel ba\u015fvurunun Mahkemenin ba\u015fvuru formu kullan\u0131larak yap\u0131lmas\u0131 ve formda istenen bilgileri i\u00e7ermesi gerekir. Ba\u015fvuruda olaylar\u0131n, ileri s\u00fcr\u00fclen S\u00f6zle\u015fme ihlallerinin ve ba\u015fvurucunun S\u00f6zle\u015fme\u2019nin 35 \u00a7 1 maddesinde \u00f6ng\u00f6r\u00fclen ko\u015fullara uygunlu\u011funun k\u0131sa, a\u00e7\u0131k ve okunakl\u0131 \u015fekilde a\u00e7\u0131klanmas\u0131 gerekir. Ba\u015fvuru ayr\u0131ca imzalanmal\u0131 ve ilgili karar ve belgelerin kopyalar\u0131yla birlikte sunulmal\u0131d\u0131r.
