Substantial compensation, potentially in the range of hundreds of thousands of euros, in the event of a fatal accident in Italy

As a result of intensive negotiations with the insurer Inter-Europa SA, our firm succeeded in obtaining compensation / non-material damages in the range of several hundred thousand euros for the relatives of a Hungarian citizen who died in a road traffic accident in Italy. We consider the success of our negotiations to lie in the fact that the damage caused by the tragedy was resolved within a short period of time and without the need to navigate the complexities of the Italian judicial system. Where Italian law applies to road traffic accidents occurring in Italy, the lump-sum compensation amounts determined by the Court of Milan apply under the Italian rules on non-contractual liability, irrespective of the actual amount of the damage suffered. These lump-sum amounts may provide for compensation running into several hundred thousand euros, both in respect of claims inherited after the deceased person (danno iure hereditatis) and claims asserted in one’s own right (danno proprio).
