Occupation, Hardship and Mining Operations in Eastern Ukraine

Case value: 800000€

We advised on whether the occupation of territory in eastern Ukraine could constitute hardship and thereby affect contractual rights and obligations arising from a major mining project. The dispute concerned goods that were contractually promised for export, but the exports could not be carried out because effective control over the relevant territory had been lost and sanctions restricted the transaction. A German court decided the dispute. The outcome is confidential.
