Hungarian Lawyers in England

Following the United Kingdom’s withdrawal from the European Union on 1 January 2021 (Brexit), lawyers qualified solely in EU Member States can no longer represent clients before the courts of England and Wales in the same manner as before. Since importantly, the common law system of the United Kingdom differs significantly from the civil law systems used throughout continental Europe. For these reasons, it is essential to obtain legal advice and representation from a lawyer qualified to advise on English & Welsh law in the following circumstances:

  • where English and Welsh law is chosen as the governing law of a contract;
  • where the jurisdiction of the courts of England and Wales is agreed in a contract;
  • where a claim must be pursued and enforced in the United Kingdom;
  • where legal representation is required in litigation before the courts of England and Wales
  • where you are involved in proceedings before the courts of England and Wales
  • where you are facing legal issues involving the police or the criminal courts of England and Wales; or
  • where you wish to immigrate to the United Kingdom.

Important Considerations for English Companies

In England and Wales, company incorporation can, in the vast majority of cases, be completed entirely online. Ongoing maintenance costs are often lower than in many European jurisdictions, and there is generally no requirement for significant initial capital, as a company may be incorporated with as little as £1 in share capital.

For international businesses, incorporation in England can offer significant commercial and tax planning advantages, while, as stated, the company incorporation process can be completed entirely online, in some cases within 24 hours.

Particular care should be taken when establishing limited liability companies under English law (Ltd/Plc), whose central administration and management is located within a Member State of the European Union. Such structures require specialist knowledge and experience, which our international legal professionals possess. Following Brexit, certain Austrian and German court decisions and legal commentary have raised issues concerning the recognition of limited liability in specific circumstances where an English company is effectively managed from within the EU.

If you are planning to establish a company in the United Kingdom, or if you wish to ensure that your legal affairs in the UK are handled with the highest level of security and professionalism, please do not hesitate to contact us. We would be delighted to represent you, your company and your commercial interests effectively.
