A Law Graduate v. Bar Association: Access to the Legal Profession and Recognition of Foreign Degrees

We represented an Austrian law graduate in proceedings against a bar association concerning admission as a trainee lawyer.

The application had been denied on the basis that the applicant held a foreign law degree. The case raised fundamental questions regarding access to the legal profession and the obligation of national professional bodies to assess the equivalence of foreign qualifications.

We challenged the refusal before the courts, arguing that an automatic rejection of foreign degrees was incompatible with European legal principles. According to the ruling, bar associations are required to examine the potential equivalence of foreign qualifications and cannot deny access solely because a degree was obtained outside their jurisdiction.

The proceedings resulted in a successful judgment for our client and are considered a landmark in a European context, clarifying the standards for recognition of foreign legal education and access to regulated professions.
