По итогам интенсивных переговоров со страховой компанией «Inter-Europa-AG» наша юридическая фирма достигла соглашения о выплате шестизначной суммы в качестве компенсации нашим клиентам, чьи родственники погибли в дорожно-транспортном происшествии в Италии. Таким образом, благодаря оперативной компенсации ущерба нашим клиентам удалось избежать длительного судебного разбирательства в итальянских судах.

Если к данному ДТП применяется итальянское законодательство, размер компенсации должен рассчитываться в соответствии с таблицей компенсаций Апелляционного суда Милана, даже если материальный ущерб не был причинен или его размер не столь велик. Такие суммы единовременной компенсации, как правило, могут достигать шестизначных цифр. Согласно нормам немецкого права о “danno iure hereditatis”, не имеет значения, в какой степени пострадал выживший родственник. Кроме того, размер требования о компенсации определяется в соответствии с принципами “danno proprio”, которые также не зависят от размера фактического ущерба, например в виде невыплаченных алиментов.
