Tras unas intensas negociaciones con la compañía de seguros Inter-Europa-AG, nuestro bufete de abogados ha llegado a un acuerdo para el pago de una indemnización de seis cifras a nuestros clientes, cuyos familiares fallecieron en un accidente de tráfico en Italia. De este modo, se ha evitado un largo proceso judicial en Italia al indemnizar rápidamente a nuestros clientes por su pérdida.

Si la ley italiana es aplicable al accidente de tráfico, la indemnización debe calcularse de acuerdo con la tabla de indemnizaciones del Tribunal de Apelación de Milán, incluso si el perjuicio económico no se ha producido o no es tan elevado. Dichas indemnizaciones a tanto alzado suelen situarse en el rango de las seis cifras. Según las normas sobre el “danno iure hereditatis” del Derecho alemán, no importa en qué medida haya sufrido el superviviente. Además, la reclamación de indemnización se determina según los principios del “danno proprio”, que tampoco tienen en cuenta la cuantía del daño real, por ejemplo, en forma de pagos de pensión alimenticia no percibidos.
