Если в договоре не оговорено иное, согласно решению Земельного суда Шлезвиг-Гольштейна трудовые отношения с генеральным директором могут быть расторгнуты и в устной форме. Суд отклонил иск бывшего генерального директора, который хотел продолжать получать вознаграждение. Однако после вынесения данного решения деловые отношения уже не существовали. Письменного отказа от прав не было, однако ответчик снял истца с учета в соответствующих органах социального обеспечения, что тот принял без возражений. В ходе семейного спора истец также заявил, что он был принят на работу в другую компанию.

Этого оказалось достаточно, чтобы LAG Шлезвиг-Гольштейн пришла к выводу, что договор с управляющим директором был ранее расторгнут по обоюдному согласию. Трудовой договор предусматривает только одностороннее расторжение, поэтому в данном случае прекращение управленческих отношений считается вступившим в силу.
