Regional Court of Celle: No Penalty for Recruiting Members for ISIS

The Regional Court of Celle found a 23-year-old guilty of recruiting members for the terrorist organisation ISIS. Nevertheless, it imposed no penalty, as the requirements for imposing a youth sentence were not currently met. Although the defendant displayed harmful tendencies, it could not be established that these tendencies made a penalty necessary.

The offender was dealt with under juvenile criminal law because, based on his moral and intellectual development, he was still considered equivalent to a juvenile.

He operated a WhatsApp group called “Allahu Akbar”, which had around 50 participants. In that group, he called on other people to join ISIS.

The decision on imposing a penalty was ultimately suspended by the Higher Regional Court of Celle for a probationary period of two years.
