L“1 de gener de 2013 va entrar en vigor una llei hongaresa que només permet als ciutadans de la UE obtenir drets d'ús de les àrees de cultiu si són ”parents propers" del propietari. Durant els darrers 20 anys, la propietat només es podia adquirir per ciutadans hongaresos, de manera que els propietaris solen ser hongaresos.

A més, la nova llei ordena que tots els drets d'ús existents siguin cancel·lats. Una discriminació amagada?

Diverses persones d'Alemanya i d'Àustria (inclosa la nostra empresa) van emprendre accions contra la llei, perquè els privaria dels seus drets sense cap compensació.

A la primavera, el Tribunal de Justícia de la Unió Europea va decidir sobre la qüestió. Va declarar que la llei constitueix una discriminació per raó de la ciutadania de l'usufructuari, perquè només hi ha una petita possibilitat que compleixi el requisit de tenir una relació familiar estreta amb un ciutadà hongarès.
A més, el Tribunal de Justícia de la Unió Europea va afirmar que l'objectiu suposat del govern hongarès, d'evitar l'especulació amb terres agrícoles, ni tan sols es pot assolir amb aquesta llei, perquè no regula el cultiu de la terra. La relació familiar no garanteix que el arrendatari estigui realment treballant la terra.

En qualsevol cas, adoptar una mesura tan radical no és proporcional a l'objectiu aparent de la llei. El Tribunal de Justícia de la Unió Europea va decidir que s'haurien pogut adoptar mesures menys dràstiques per a aquest propòsit.

Finalment, també seria inapropiat retirar els drets d'ús dels usufructuaris sense concedir-los una compensació raonable. Per tant, la llei és encara més desproporcionada.
