Un ciutadà de Potsdam ha sol·licitat a l'Ajuntament de Wolfsburg emprendre accions legals contra VW a causa de l'escàndol del dièsel. Ho va justificar pel fet que les persones responsables de VW han prohibit el dret mercantil, així com la necessitat d'una prohibició d'activitats comercials per protegir la seva salut.

La ciutat de Wolfsburg havia rebutjat la sol·licitud perquè el sol·licitant no podia al·legar que hagués estat afectat en els seus propis drets públics subjectius.

La següent reclamació presentada pel sol·licitant va ser desestimada per l'OVG de Lüneburg. Va confirmar la decisió presa per la ciutat de Wolfsburg segons la qual la sol·licitud era inadmissible per manca de drets subjectius i públics vulnerats. § 35 I 1 del codi industrial regula la prohibició d'activitats comercials i només serveix per a la protecció del públic en general, no per als interessos particulars de tercers. L'estat ja aborda possibles riscos per a la salut associats a l'emissió de contaminants de diverses maneres. Per aquest motiu, el sol·licitant no pot invocar el seu dret fonamental a la integritat física.
