Un ciudadano de Potsdam ha presentado una solicitud ante el Ayuntamiento de Wolfsburgo para emprender acciones legales contra VW a raíz del escándalo del diésel. Ha justificado su solicitud alegando que los responsables de VW han infringido el Derecho mercantil, así como la necesidad de prohibir las actividades comerciales para proteger su salud.

El Ayuntamiento de Wolfsburgo había desestimado la solicitud porque el solicitante no podía alegar que se hubieran visto afectados sus propios derechos públicos subjetivos.

El Tribunal Administrativo Superior (OVG) de Lüneburg desestimó el recurso presentado por el demandante. Confirmó la resolución dictada por el Ayuntamiento de Wolfsburgo, según la cual la demanda era inadmisible por no haberse vulnerado ningún derecho subjetivo ni público. El artículo 35, apartado 1, del Código Industrial regula la prohibición de actividades comerciales y tiene por único objetivo la protección del interés general, no los intereses individuales de terceros. El Estado ya aborda de diversas formas los posibles riesgos para la salud asociados a la emisión de contaminantes. Por este motivo, el demandante no puede invocar su derecho fundamental a la integridad física.
