A Municipality v. Arbitral Proceedings: Challenging Jurisdiction Before the Vienna Commercial Court

We represented a Hungarian municipality in proceedings before the Commercial Court of Vienna seeking declaratory and injunctive relief against ongoing arbitral proceedings. 

The case centred on whether the arbitral tribunal had jurisdiction at all. In parallel to the arbitration, we initiated court proceedings to obtain a declaration that the tribunal lacked jurisdiction and to prevent the continuation of the arbitral process. 

The matter raised fundamental questions on the relationship between arbitral tribunals and state courts, and on the availability of negative declaratory relief to halt arbitration proceedings. It required careful coordination between arbitration strategy and litigation before Austrian courts. 

The proceedings ultimately concluded with a comprehensive settlement covering both the court action and the arbitration, providing a commercially viable resolution to the dispute.
