Notes on Arbitration Proceedings

Arbitration proceedings differ in a number of important respects from proceedings before state courts, and an understanding of these differences may have a decisive impact on the outcome of an arbitration. This begins with the selection of the arbitrator. In arbitration proceedings, the arbitrators are appointed by the parties to the dispute themselves. The parties can therefore choose arbitrators who are able to assess and evaluate the particular factual and legal features of the dispute appropriately. In addition, arbitrators must be familiar with, and able to apply, the arbitration rules agreed by the parties, which may vary from case to case. Where the parties have agreed that proceedings abroad are to be conducted in a foreign language, the selection of suitable arbitrators may become even more complex.
