Житель Потсдама подал в администрацию города Вольфсбурга заявление о возбуждении судебного разбирательства против компании VW в связи с дизельным скандалом. Он обосновал это тем, что ответственные лица компании VW нарушили нормы хозяйственного права, а также тем, что для защиты его здоровья необходимо наложить запрет на ведение коммерческой деятельности.

Город Вольфсбург отклонил заявление, поскольку заявитель не смог доказать, что его собственные субъективные общественные права были ущемлены.

Следующая жалоба, поданная заявителем, была отклонена Высшим административным судом Люнебурга (OVG Lüneburg). Суд подтвердил решение города Вольфсбурга о том, что заявление является неприемлемым в связи с отсутствием нарушенных субъективных и общественных прав. § 35 ч. 1 п. 1 Промышленного кодекса регулирует запрет на коммерческую деятельность и служит исключительно для защиты общественных интересов, а не индивидуальных интересов третьих лиц. Государство уже различными способами противодействует возможным угрозам здоровью, связанным с выбросами загрязняющих веществ. В связи с этим заявитель не может ссылаться на своё основное право на физическую неприкосновенность.
