Als Estats Units, el grup implicat ha estat reemborsant els clients afectats per l'escàndol de les emissions dièsel. A Alemanya, però, els clients que condueixen un cotxe dièsel manipulat només rarament presenten reclamacions contra els concessionaris o els fabricants. Tot i això, generalment tenen dret a diverses reclamacions.

I. Els teus drets contra el concessionari de cotxes

El seu vehicle que conté un programari d'emissions manipulat pateix un defecte material. L'article 439 del BGB (Codi Civil alemany) li permet exigir un compliment posterior en forma d'una actualització del programari. Si no és raonable permetre que se us faci una reparació del programari, per motius com ara una relació de confiança alterada entre vostè i el concessionari, pot declarar la seva retirada del contracte d'acord amb l'article 323 del BGB.  El contracte es revertirà: a canvi del vehicle manipulat, recuperaràs els teus diners. Si ja fa temps que condueixes el vehicle, simplement es compensarà l'ús dels quilòmetres recorreguts.

II. Els teus drets contra el fabricant del cotxe

Els qui van instal·lar el programari manipulat al vostre vehicle no eren els concessionaris d'automòbils, sinó els fabricants. Es tracta d'una conducta fraudulenta que vulnera els principis morals acceptats, segons va decidir el jutjat de districte de Dortmund el juny de 2017. Per tant, podríeu tenir dret a reclamar una indemnització al fabricant del vehicle per “engany immoral”, tal com estableix l'article 826 del BGB, si l'engany ha conduït a la vostra decisió de formalitzar el contracte.

Com a conductor d'un cotxe manipulat, pots estar exposat a diversos riscos i incerteses. Per exemple, el valor de revenda del cotxe serà considerablement inferior al d'un cotxe convencional. També és possible que la teva consciència mediambiental t'hagi impedit comprar un cotxe que emeti massa contaminants.

Així doncs, si pots demostrar de manera convincent que no hauries comprat el cotxe si haguéssis sabut dels nivells més alts de contaminació de l'aire, el fabricant del cotxe podria haver de pagar-te una compensació.
