HUNGARY: HANDLING REAL ESTATE TRANSACTIONS, INHERITANCES AND SUBSIDIARIES, INCLUDING IN THE CONTEXT OF GERMAN INSOLVENCY PROCEEDINGS

From Nuremberg, we also handle for you all aspects of purchase and sale transactions involving real estate located in Hungary. In doing so, we prepare real estate purchase agreements under Hungarian law and also ensure completion in the land register, i.e. the registration of the sale or acquisition of ownership with the competent Hungarian land registry office.

Handling Matters in Hungary for German Insolvency Administrators

The same applies to advising on and handling the acquisition or sale of companies, shareholdings or corporate entities with their registered office in Hungary. In addition, on behalf of German insolvency administrations, we also carry out the winding-up of Hungarian subsidiaries of German insolvency debtors — in the past, for example, for insolvency administrator Dr. Jaffé, Munich (KirchMedia, Grundig) — through to deletion from the register before the locally competent company court.

Handling Inheritance Matters in Hungary

Within the Hungarian judicial administration, local municipal notaries are functionally responsible for handling inheritance proceedings. A particular feature of these notaries’ procedure is, on the one hand, that they often set response deadlines without regard to foreign heirs or other foreign participants in the proceedings, frequently very short deadlines of eight days, so that the predetermined deadline has often already expired before postal delivery reaches the German heir. On the other hand, compliance with deadlines is often made even more difficult by the fact that Hungarian notaries, usually in rural districts, often do not provide fax or email details in their Hungarian-language communications. This disadvantage does not, at least at the opening stage of the proceedings, regularly result in the forfeiture of rights, provided that the person concerned responds immediately and in Hungarian, the official language.
