Does your business operate as an estate agency, property advertising platform or credit institution involved in the Wekerle Plusz programme? Government Decree No. 411/2026 (XI. 3.) introduces new advertising requirements and clarifies estate agents’ liability. Here is what your business needs to know.
Credit institutions must include the following statement in advertisements for Wekerle Plusz home loans:
“The subsidies forming part of the home loan advertised are provided by the Government of Hungary.”
Estate agents and online property advertising platforms must display the programme’s logo when advertising a property as meeting the Wekerle Plusz eligibility criteria. This also applies to promotions on social media.
The requirement also covers businesses carrying out real estate agency activities under TEÁOR’25 code 6831. A separate ministerial decree sets out the detailed requirements for displaying the information and using the logo.
When Can Agents Be Exempt from Liability for Damages?
Under the new rule, estate agents and online advertising platforms are not liable for losses arising where, because of inaccurate information supplied by the seller, an advertised property turns out not to meet the programme’s statutory eligibility criteria.
This is not a blanket exemption: an agent’s own misleading conduct may still have legal consequences, and consumer protection requirements continue to apply.
The amendments generally took effect on 4 November 2026; certain provisions governing the transition from Otthon Start apply from 16 November 2026.
Review your advertisements, ensure that the required disclosures and branding are in place, and keep records of the information received from sellers. These records may also be important when relying on the exemption from liability.
