We represented a Canadian testamentary executor in connection with the intended sale of real estate in Germany forming part of a deceased’s estate. The matter required demonstrating to German courts and authorities that, under the applicable law of British Columbia, ownership of estate assets does not pass directly to heirs but remains vested in the estate, administered by the executor. This concept, unfamiliar within a continental legal framework, required careful legal translation and explanation in order to align common law estate administration with German property law principles.
