Hi ha casos en què no és possible evitar contractar un advocat col·legiat a Hongria. En altres casos, la contractació d'un advocat no és obligatòria, però és molt recomanable.

1. On necessites un advocat a Hongria?

• davant del tribunal de districte, del tribunal regional superior i del tribunal suprem

Amb molt poques excepcions, és obligatori tenir un advocat davant dels tribunals superiors d'Hongria. Si intenteu comunicar-vos amb el tribunal sense un advocat col·legiat, el tribunal considera aquesta comunicació invàlida. A causa de les normes relativament estrictes, ni tan sols els advocats estrangers (per exemple, d'Alemanya, d'Àustria o fins i tot advocats de parla hongaresa dels països veïns) poden defensar un cas si no compten amb un advocat localment registrat.

• davant del registre de la propietat

És possible que pugueu obtenir vosaltres mateixos els documents (extracte, etc.) que necessiteu, però en la majoria dels casos el registre de la propietat només es comunica amb advocats i notaris. Això és el cas quan un certificat (p. ex. contracte de compravenda) constitueix un nou dret (p. ex. dret de propietat) que s'ha de registrar. El mateix s'aplica a l'esborrament de drets o obligacions registrades rellevants (per exemple, l'usufruct).

• Certificacions

En la majoria de casos, quan cal designar un notari a Alemanya, a Hongria només és obligatori estar representat per un advocat. Per a aquest tipus d'accions (p. ex. constitució d'una societat, venda d'una propietat) també es pot designar un notari, però normalment un advocat és una alternativa molt més flexible i rendible.

• Registres de societats i registres comercials

A Hongria, aquestes inscripcions només es fan en format electrònic, després que l'advocat o el notari hagi certificat els documents i els hagi digitalitzat. Per a aquestes tasques cal una signatura electrònica especialitzada i qualificada per comunicar-se amb els registres, de manera que un profà ni tan sols pot adreçar-se a les autoritats.

2. Quan la designació d'un advocat no és obligatòria, però aconsellable?

• davant del jutjat local

Davant del jutjat local, les reclamacions poden arribar fins a 100.000,00 € (en comparació amb Alemanya, on el límit és 5.000,00 € ). Tot i que un advocat no és obligatori, desaconsellem estrictament l'autorrepresentació.

• redactar un testament

Teòricament, pots fer una disposició testamentària final en forma de “certificat amb plena força probatòria”. La consideració d'altres aspectes (com la part obligatòria) normalment requereix la contractació d'un especialista.

• la redacció de contractes

No cal que tot tipus de declaració sigui certificada. Tot i això, és preferible consultar un especialista en aquests casos.
