A Listed Company v. Cross-Border Trade Dispute: Application of Foreign Law Before Hungarian Courts

We represented a listed company in a dispute concerning railway shipments within the Eurasian Economic Union, brought before Hungarian courts.

The case required the Hungarian court to apply elements of Kazakh law, particularly in relation to the applicable interest rates. This raised complex questions of private international law and the interaction between different legal systems in a commercial dispute spanning multiple jurisdictions.

The matter was handled by our Budapest office by Peter Taller, and required coordination with a parallel procedure before a commercial court in Kyiv, which had to be taken into account throughout the proceedings.

We supported the client in analysing and presenting foreign law before the Hungarian courts and in coordinating the legal and linguistic aspects of the case. Native-level Russian language capability proved essential in navigating the contractual documentation and communications involved.

The matter ultimately concluded with a comprehensive settlement, providing a pragmatic resolution to the dispute.
