Salvo que se acuerde lo contrario en el contrato, según el Tribunal Regional de Schleswig-Holstein, la relación laboral de un director general también puede rescindirse verbalmente. El tribunal desestimó la demanda de un antiguo director general, que quería seguir percibiendo su remuneración. Sin embargo, la relación laboral ya no existía tras la sentencia dictada. No existía una renuncia por escrito, pero el demandado había dado de baja al demandante de los organismos de la Seguridad Social correspondientes, lo que este había aceptado sin protestar. En un litigio de derecho de familia, el demandante también declaró que estaba empleado en otra empresa.

Esto bastó para que el LAG de Schleswig-Holstein concluyera que el contrato del director general ya había sido rescindido previamente de mutuo acuerdo. El contrato de trabajo solo prevé rescisiones unilaterales; por lo tanto, en este caso, la rescisión de la relación directiva es efectiva.
