The EU Blue Card is one of the European Union’s most significant residence permits designed for highly qualified third-country nationals. In Hungary, the rules governing the EU Blue Card are set out in Act XC of 2023 on the Entry and Residence of Third-Country Nationals (hereinafter: the “Act”), which, as of 1 January 2024, introduced a new, structured system regulating the legal status of highly qualified employees.
Under the Act, the EU Blue Card is a residence permit that entitles its holder to reside in the territory of a Member State and to engage in highly qualified employment under the conditions defined by law.
The purpose of the EU Blue Card is to provide a predictable and competitive framework for residence and employment to professionals with higher education qualifications or outstanding professional experience whose expertise is of strategic importance to the EU labour market. Accordingly, the Act regulates the EU Blue Card as a distinct category, offering more favourable conditions compared to the “traditional” guest worker permit.

Meeting the salary threshold is of particular importance, as the EU Blue Card is intended to attract professionals who generate high added value.
Please note that the above does not constitute an exhaustive list of requirements. The Act establishes a conjunctive system of conditions, meaning that all statutory requirements must be met simultaneously in order to qualify for an EU Blue Card.
The legislation also specifies exclusion grounds. For example, individuals who are recognised as admitted persons under the Asylum Act and have applied for temporary protection are not eligible for an EU Blue Card.
As a general rule, the EU Blue Card may be issued for a minimum of two and a maximum of four years. It may be extended; however, particular attention must be paid to the validity of personal documents (such as passports) that serve as the basis for lawful stay. These documents must remain valid throughout the entire period of residence in Hungary. Since extending such documents—especially while already residing in Hungary—may be complicated, forward planning is essential.
It is important to emphasise that the EU Blue Card application procedure is complex. The authorities conduct a detailed examination of the employer’s submitted documentation, the classification of the position, the compliance of the salary level, and the authenticity and recognition of the applicant’s qualifications—both under Hungarian and EU standards. An incomplete or improperly prepared application may result in rejection.
